Will of Christopher Hitch    |

       I Christopher Hitch of Fauquier County do hereby make my last will and testament in manner and form following, that is to say 1st I desire that the lease for one hundred acres of land lying on Rattlesnake Mountain be immediately sold after my decease and out of the money arising therefrom all my just debts and funeral expenses be paid and should the same arising from such sale be insufficient for the above purposes, then it is my will and desire that the balance be made up out of the sales of my perishable estate and paid to my several creditors. 2ndly I give to my three sons Leven Hitch, Elias Hitch and Loyd Hitch the lease for the lott of land I now live on containing one hundred and fifty acres, also another lease adjoining the same containing thirty six acres to be equally divided amongst them.
3rdly I give to my daughter Airy her choice of a horse.
4thly I give my daughter Betsy Arnold her choice of a cow and calf.
5thly I give my daughter Lucy Harris a bed and furniture, also her choice of a cow and calf.
6thly I give my daughters Airy Hitch, Nelly Hitch and Darkey Hitch a bed and furniture, one cow and calf and two sheep each.
7thly I give to my sons Nathan Hitch, John Hitch, Wiseman Hitch and Archibald Hitch and to my daughters Susan Smoot, Peggy Smoot, Sally Arnold, Becky Arnold and Lucy Harris five pounds each to be paid in cash at the end of nine months after my decease.
8thly I give my sons Elias Hitch and Loyd Hitch each a colt of the value of ten pounds.
9thly I give all the rest of my estate both real and personal of what nature and kind soever it may be not herein before particularly disposed of to my sons Leven Hitch, Elias Hitch and Loyd Hitch and to my daughters Airy Hitch, Nelly Hitch and Darkey Hitch to be equally divided amongst them. And lastly, I do hereby constitute and appoint my sons Nathan Hitch and Leven Hitch executors of this my last will and testament, hereby revoking all other or former wills by me heretofore made. Witness my hand and seal this 25th November 1803.

In the name of God Amen, I Christopher Hitch being weak and low and having heretofore made and executed my last will and testament do add the following codicil which it is my will and desire may be incorporated with and taken as a part of my said will. That is to say, it is my will and desire that my three daughters Airy Hitch, Nelly Hitch and Darkey Hitch live in the house I now occupy as long as they live unmarried and enjoy in common with my three sons Levin Hitch, Elias Hitch and Loyd Hitch the profits of the two leases before willed to my said three sons during their residences as aforesaid or until they or either of them marry, in which case, the proportion of the one marrying is to cease from the time of her marriage. It is also to be understood that this provision is made for my said daughters only while they remain single but to cease at the time of their several marriages. It is further my will and desire that my mother may live with my said three daughters and be maintained out of my estate as long as she lives with them, but it is not intended she shall be maintained out of my estate unless she lives with my said daughters. And lastly it is my will that my two sons Elias Hitch and Loyd Hitch have a bed and furniture each in addition to the property before give them. In witness whereof I have hereunto set my hand and seal the 14th day of May 1805 hereby in all things confirming my said last will with the addition of this codicil.

Signed, sealed, At a court held for Fauquier County the 22nd day of July 1805.
       This will was proved by the oaths of William Clarkson and Thomas Foley witnesses thereto and the codicil thereto annexed being also proved by the oaths of William Clarkson and Matthew Neale witnesses thereto ordered to be recorded. And on motion of Nathan Hitch and Leven Hitch the executors therein named who made oath and together with William Clarkson, Isaac Arnold and Matthew Neale their securities entered and acknowledged bond in the penalty of four thousand dollars conditioned as the law directs, certificate is granted them for obtaining a probate thereof in due form.
