James Fleming to Thomas Smoot ~ A Deed ~ 1795

     This indenture made this 10th day of March in the year 1795 between James Fleming of the County of Hampshire and State of Virginia of the one part and Thomas Smoot of the same County and State aforesaid. Witnesseth that for and consideration of the sum of thirty pounds current money of this state to the said Fleming in hand by the said Thomas Smoot on or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged and therefore doth release, acquit and discharge the said Thomas Smoot his heirs and executors and by these presents he the said James Fleming hath granted, bargained, sold, released, aliened and confirmed and herefore doth grant, bargain, sell, alien and confirm unto the said Thomas Smoot his heirs and assigns a certain piece or tract of land situate in the County of Hampshire on a small drain of Mill Creek, and bounded as followeth, to wit, Beginning at a black oak and white oak corner of Lockhart’s land on the line of the old survey of Patterson and running N 60º W 30 poles to a large white oak corner of another survey of said Lockhart, thence N 30º E along his line 80 poles to a white oak, thence S 50º E 63 poles to a white oak said to be High’s corner, thence S 45º E 22 poles to a white oak in a cleared field, thence S 74º W 86 poles to the beginning, containing 30 acres, being part of a tract of land that was conveyed to the said Fleming from Abraham Mosby as another Instrument of Writing will more plainly show. With all houses, buildings, orchards, wood ways and water courses, profits and commodities, together with all and singular the premises, hereditaments and all its appurtenances unto the said Thomas Smoot, his heirs, executors and assigns against the claim and demand of his the said James Fleming and his heirs, executors and assigns and all and every other person and persons whatsoever shall warrant and forever defend by these presents free and clear of and from all other and former gifts, grants, bargains, sales and dower right and title of dower, judgements, executions, titles, troubles, charges and incumbrances whatsoever made, done or suffered to be made or done by him the said James Fleming or any other person or persons (the quit-rents or taxes hereafter to become due and payable in respect of the premises only excepted). In witness whereof him the said James Fleming hath signed, sealed and acknowledged this present deed the day and year above written
