This Indenture made the 20
th day of
September in the year of our Lord one thousand
eight hundred and thirteen between Jacob Smoot of the County of Hampshire and
Commonwealth of Virginia and Jane his wife of the one part and Joshua Smoot
of the same county of the other part. Witnesseth that the said Jacob Smoot and
Jane his wife for and in consideration of the sum of three hundred and eighty dollars
current money of the United States to him the said Jacob Smoot in hand well and truly
paid, at or before the sealing and delivery of these presents the receipt whereof is hereby
acknowledged, they the said Jacob Smoot and Jane his wife have granted, bargained and
sold, and by these presents do grant, bargain, sell, convey and confirm unto the said Joshua
Smoot, his heirs and assigns a certain tract or parcel of land situate, lying and being in the
County of Hampshire aforesaid adjoining the lands of John Torrance, John Elliott and
others on the drains of the North River of Great Cacapehon and bounded as followeth:
Beginning at a large white oak corner to John Elliott and running thence with his line S 27°
W one hundred and eighty four poles to a forked pine, thence leaving said Elliotts line S 85°
one hundred and two poles to a pine on a south hillside, corner to John Torrance, thence with
his line reversed N 27° E about one hundred and eighty four poles to a locust post and pine, his
corner, thence leaving said Torrances line, N 85° W one hundred and ten poles to the beginning,
containing ninety eight acres more or less, being part of a survey made and bearing date the

of June 1788 and a patent obtained by Rees Pritchard under the signature of Beverly Randolph, Esq.,
Governor of the Commonwealth of Virginia, bearing date

one thousand seven hundred and ninety nine and conveyed by the said Rees Pritchard to John Smoot,
now dec
d, by deed of bargain and sale now of record
in the County Court of Hampshire and devised
by the said John Smoot dec
d unto the said Jacob
Smoot by the last will and testament of the said John
Smoot dec
d bearing date the

th day of December 1807 which is also now of record in the County
Court of Hampshire, to which reference is hereby had (by which last will and testament the third part
of the above described premises is reserved as the widows for her lifetime, which is hereby reserved
in this conveyance), and also all houses, buildings, orchards, ways, waters, water courses, hereditaments
and appurtenances whatsoever to the said premises belonging or in anywise appertaining, and the reversion
and reversions, remainder and remainders, rents, issues and profits thereof (except as before reserved the
widows dower her lifetime) and also all the estate, right, title, interest, claim and demand whatsoever of them
the said Jacob Smoot and Jane his wife, of, in and to the said premises and every part thereof. To have and
to hold the said lands and premises hereby granted and all and singular other the premises above mentioned
and every part and parcel thereof (except as before excepted) with the appurtenances unto the said Joshua
Smoot, his heirs and assigns forever; and the said Jacob Smoot and Jane his wife for themselves and their
heirs, the said lands and premises and every part thereof (except as before reserved) against themselves
and their heirs and against all and every other person and persons whatsoever to the said Joshua Smoot,
his heirs and assigns shall and will warrant and forever defend by these presents. In witness whereof the
said Jacob Smoot and Jane his wife have hereunto set their hands and seals the day and year first above
written.
