     This indenture made the fourth day of January 1844 between Mary Smoot of Preston County and the State of Virginia of the one part and Daniel Haines of Hampshire County and the state aforesaid of the other part. Witnesseth that the said Mary Smoot for and in consideration of the sum of seventy five dollars current money of the United States unto her in hand paid by the said Daniel Haines before the sealing and delivery hereof the receipt whereof is hereby acknowledged have granted, sold, aliened, enfeoffed, released and confirmed and by these presents do grant, bargain, sell, alien, enfeoff and confirm unto the said Daniel Haines his heirs and assigns forever all that equal full and undivided one fifth part of a tract or parcel of land situate lying and being in Hampshire County adjoining land of John Ambler and David Shafer supposed to contain one hundred and seventy acres be the same more or less it being her part of the land formerly owned by her father Henry Haines decd to have and to hold the above described premises with the appurtenances to the same belonging or in anywise appertaining to the only proper use, benefit and behoof of him the said Daniel Haines his heirs and assigns forever for one fifth part of said tract of land as above described and the said party of the first part for herself and her heirs do covenant to and with the said party of the second part his heirs and assigns that at the time of sealing and delivering of these presents she is seized of good, sure, perfect and indefeasible estate of inheritance in fee simple in the above described premises free from all claims, liens or encumbrances and that she has good right and authority to convey the same in manner and form aforesaid and that she will warrant, secure and forever defend the said premises to the said party of the second part and his heirs and assigns free from the claims or claim of all persons whatsoever. In testimony whereof the said Mary Smoot has hereunto signed her name and affixed her seal the day and year above written.

Preston County, to wit:
     We William McGee and Hugh Evers, Justices of the Peace in and for the said county in the State of Virginia do hereby certify that Mary Smoot party to the above deed personally appeared before us in our county aforesaid and acknowledged the same to be her act and deed and desired us to certify the said acknowledgement to the clerk of the county court of Hampshire County in order that the same may be recorded. Given under our hands and seals this 4th day of January 1844.
