DEED
Deed Book 96 at page 268
on file at
Office of County Recorder
Elbert R. Edwards
to
R.L. Jackson, Albert Smith and
Joseph Wiley, Jr., as Trustees
Dated October 4, 1922, Recorded
October 5, 1922
This is the deed to the Greenstone Cemetery made to the above named three men as "Trustees." While the deed does state that the "said parcel of land is now used as and [sic] Indian Cemetery," California law did not then, nor does it now, discriminate as to which "inhabitants" of the city, town, or village needed to use a cemetery in order for the title to that cemetery to vest in the public. By 1922, the criteria established under the prescriptive conditions of former Political Code section 3105 had been met, and title to this cemetery did vest in the public through operation of that law. There are only two pages to this deed. They are both presented here.
