David Wells' Will Found in Macon County, Georgia Will
Book "a" on page 202.
MACON COUNTY, GEORGIA - In the name of God Amen,
I, David Wells of said State and County being of advanced
age and knowing that I must shortly depart from this world,
deem it right and proper both as respects myself and my
family that I should make a disposition of the property with
which a kind Providence has blessed me, that I have not
already disposed of by deed of gift.
ITEM 1 - I desire and direct that my body be buried in a decent and
Christianlike manner, suitable to my circum-
stance and condition. My soul I trust shall return to rest
with God who gave it, as I hope for eternal Salvation through the blessed Lord
and Savior, Jesus Christ which
religion I have professed and as I humbly trust and enjoyed
for thirty five years.
ITEM 2 - I desire and direct that all my just debts be paid
without delay by my Executor hereinafter named as I am
unwilling my creditors should be delayed of their rights,
especially as there is no necessity for delay.
ITEM 3 - I give and devise to my beloved wife, MARTHA,
with whom I have lived in the strictest quiet and love for sixteen years, my
horse and buggy, one two-horse waggon, 2 cows and calves and one sow and pigs.
All my household and kitchen furniture, a supply of provisions for herself and
farming purposes for one year.
ITEM 4 - I give and bequeath to my son,THOMAS WELLS
the east half of lot of land No. one hundred & twenty five in
the first district of Originally Muscogee, now Macon County.
Also two cows and calves, one sow and pigs and a sufficiency of provisions for
himself and farming purposes for one year to be disposed of at his death as he
may see
proper.
ITEM 5 - I hereby appoint my son, J. W. WELLS, Trustee
for my said son, THOMAS WELLS and vest in him the legal title of the property
herein bequeathed to my son
Thomas to be used and enjoyed by him the said Thomas
during his natural life and then disposed of as provided in the fourth article
of this my will. ITEM 6 - I hereby give and bequeath to my son J. W. WELLS, all
the balance of my property of all kinds, not disposed of by deed of gift or
will.
ITEM 7 - I hereby constitute my son, J.W.WELLS Executor of this my last will and
testament this 2nd day of February, 1872. Signed: David (X) Wells
