Francis Marion BRYAN Will

 

Georgia, Macon County
I, Francis Marion Bryan of said county and state being of sound
and disposing mind and memory do make, ordain and publish this my
last will and testament hereby revoking all others heretofore
made.

Item 1. I give, devise and bequeath unto my beloved wife, Annie
Elizabeth Bryan, if she should survive me, all of my property of
every kind, of which I may die possessed, real, personal and
mixed to have and to hold the same to my said wife for and during
her natural life except as to my household furniture which I give
to her absolutely to do with as she pleases.

Item 2. It is my will and desire that at the death of my said
wife, my plantation known as the home place, consisting of lots
of land numbers two hundred and twenty three (223), two hundred
and twenty four (224) and two hundred & twelve (212) and my
plantation . . . consisting of lots of land numbers one hundred
and sixty seven (167) and one hundred seventy six (176), all
being in the 1st district of said county of Macon be sold for
cash and that to such amount as may be realized from such sale,
there be added the sum of five thousand dollars to be taken from
any money belonging to my estate, and that the aggregate amount
thereof be divided into five equal parts, and these I give,
bequeath and devise as follows: One part or share to my brother,
John L. Bryan, or if he should be [not] in life, to the children
of said John L. Bryan;one part or share to the children of my
deceased brother Andrew Jackson Bryan; one part or share to my
sister Mrs. Susan E. W. Massee or if she be not living, then to
her children; one part or share to my sister, Mrs. Malissa Carson
or if she be not in life, then to her children, and the remaining
one part or share to the children of my deceased brother Jasper
N. Bryan.

Item 3. It is my will and desire that at the death of my said
wife, my lands known as the Carson Place, consisting of lots of
land numbers two hundred and five (205), two hundred and six
(206) two hundred and seven (207), two hundred and eight (208),
two hundred and eleven (211), and seventy five acres of one
hundred and ninety four (194), in the first district of said
county be sold for cash that the amount realized from such sale
be divided into five equal parts or shares, which I give, devise
and bequeath as follows: one of said parts or share to the
children to the children (sic) of my deceased brotherin law John
T Carson; one of said parts or share to the children of my
deceased brotherin law James A. Carson, one of said parts or
share to my neice, Mrs. Laura J. Massee, wife of Oliver Jerome
Massee or if she be not in life, then to her children: one of
said parts or shares to the children of my deceased brotherin law
Captain Joseph P Carson and the remaining one part or share to
Mrs. Mary J. Hicks, wife of A. W. Hicks or if she be not living
then to her children.

Item 4. I give and devise, at the death of my said wife, to my
nephew Joseph J. Carson, son of James J. Carson (sic), deceased,
lot of land number two hundred and four (204), and eighty acres
of lot number one hundred & ninety five (195) both of said lots
being in the first (1st) district of said county, all being ____
body and bounded as follows: one (sic) the east by my [home?]
place and the road known as the river road, on the south by land
of L. P. Hicks, and W. T. Barrow, on the west by the lands of Wm
Neisler and lands of J_____ Carson and the road known as the
middle road and on the north by lands of JC & JN Bryan, to have
and to hold the said lands to him the said J J Carson, forever in
fee simple.

Item 5. I give and bequeath at the death of my said wife to my
nephew Oliver Jerome Massee fifteen hundred dollars to be paid to
him out of any money belonging to my estate.

Item 6. I give and bequeath at the death of my said wife to
Adeline Hines, the colored woman who has served my family as a
cook for quite a number of years, the sum of one hundred and
fifty dollars to be paid out of any money belonging to my estate.

Item 7. The residue of my estate I give, devise, and bequeath at
the death of my said wife to my sister, Mrs. Malissa Carson and
her children share and share alike in fee simple.

Item 8. It is my will, desire and I hereby direct that such
property as Mrs. Minnie M. Farmer, daughter of Mrs. Malissa
Carson may acquire under and by nature of this will shall be and
remain the separate property of her the said Minnie M. Farmer and
not subject to the debts of her present or any future husband.

Item 9. It is my will and desire that my property shall be kept
together during the life time of my wife, if she should survive
me and that she ________________________________ the business and
manage the same as she may see proper without any authority or
order of court.

Item 10. It is my will and desire that so soon as may be
expedient after the death of my said wife my Executors shall
proceed to settle up my estate, and I hereby give them the
authority to make any sales of lands or other property without
order of court and at either private or public sale as they may
think for the best interest of my estate.

Item 11. It is my will and desire that my executors be excused
from making returns to the Ordinary.

Item 12. I hereby nominate and appoint my beloved wife, Anne
Elizabeth Bryan, Oliver Jerome Massee and Joseph J. Carson all of
said county, as the Executors of this my last will and testament.

I Francis Marion Bryan of said county having here to fore (sic)
made and executed my last will and testament the same having been
signed on February 22nd 1895, and witnessed by T. W. Pool, F F
Paris, E J Frederick and H. Bieland, and being desirious of
making some changes as to the disposition of my property as in
said will contained, and being of sound and disposing mind and
memory do hereby make this codicile to my said last will and
testament.

Item 1. It is my will and desire that my sister Mrs. Melissa
Carson, if she should survive my wife, shall at the death of my
wife, take and have an estate for and during her natural life in
and to my plantation known as my home place said plantation,
consisting of lots of land numbers two hundred & twenty three
(223), two hundred and twenty four (224) and two hundred and
twelve (212) in the first (1st) district of said Macon county and
at the death of said Mrs. Carson, that said lands be sold and
divided as directed in item 2 of my said will.

Item 2. It is my will and desire to so alter and amend item 8 of
my said will, that the property therein referred to as acquired
by Mrs. Minnie Farmer daughter of Mrs. Melissa Carson, undersaid
will, shall at the death of the said Minnie M. Farmer, descend to
her children and be divided among her children, share and share
alike.

Item 3. In addition to my wish as set forth in Item 9. of my
said will, it is my will and desire that my wife shall not be
compelled to keep my property together, but that she may at any
time if she thinks proper, sell my part of the same and make
disposition and distribution thereof in accordance with my said
will and this codicile.

the subscribers who subscribe the names hereto in the presence of
said testator (at his insistence and request) and of each other,
