Abstract of Will of John R. Felton, planter of Macon County
Georgia.
Item 1 - Just debts be paid, buried Christian manner and a
marble monument to be erected over my remains and en-
closed by a substantial iron or granate fence, not to cost more than one
thousand dollars.
Item 2 - To brother, NOAH FELTON of Talapoosa Co., Ala-
bama and LEROY M. FELTON of Macon Co., Ga. and WILLIAM H. HARRELL of Gates
County, North Carolina,
Twenty-0ne (21) Negro slaves to be selected for the uses
and purposes to wit: For the sole and separate use of my
seven nieces (7) hereinafter named: Elizabeth Ann Welsh;
Ruthy Jacoline Welsh; Martha Mariah Welsh and Sarah M. Welsh, daughters of my
sister, Ann Welsh, and Mary Fran-
ces Hare, Jane Elizabeth Hare and Eveline Hare, daugh- ters of my sister, Louisa
Hare, My said sisters now residing in Gates County N.C.
[There are a number of stipulations then]
EXCEPT AS FOLLOWS; My niece Fanny Hancock, formerly Fanny Harrell, daughter of
James H. Harrell is not
in any event to receive any thing from my estate.
ITEM 3 - I wish estate both real & personal be kept togeth-
er until the death of my two sisters.
Item 4 - To my nephew NOAH B. FELTON, son of DAVID
FISHER FELTON, forty-two (42) acres of land in Gates Co., N.C. known in the
division of the Estate of NOAH
FELTON as lot No. nine (9). If at his death he has no heirs,
leave to his brothers and sisters then living in equal shares.
ITEM 5 - To Nephew, JOHN M. FELTON, son of my broth-
er, DAVID FISHER FELTON, forty-two (42) acres known
in the division of Estate of NOAH FELTON as Lot No. 6.
ITEM 6 - To ELIZA ANN GATLIN, daughter of DAVID FISHER FELTON, forty one acres
in Gates Co.,NC known
in the digision of the Estate of NOAH FELTON, as lot No.4.
ITEM 7 - To niece MARTHA LOVENIA FELTON daughter
of DAVID FISHER FELTON 40 acres-Gates Co.NC Lot No.1 in the division of the
Estate of NOAH FELTON
ITEM 8 - To sister, Louisa Hare during her life and at her death to her
children, the place whereon she now resides.
ITEM 9 - All the rest of my Estate not herein disposed of, I bequeath to my
other nephews and nieces in equal shares.
After accounting the property given to the children of David Fisher Felton, then
share equally with the others,
The children of John M. Felton, son of Shadrick R. Felton,
the children of Noah B. Felton, not him and Fanny Han- cock and her heirs
excluded from any participation as above stated.
ITEM 10 - Appoint Leroy Monroe Felton and William H. Felton, Trustees
Testamentans mardians of the children of
John M. Felton, son of shadrick R. Felton, also appoint them together with
____Harrell of Gates Co. NC, Trustees
and Testamintars Mardians (?) of the children of Noah B. Felton.
ITEM 11 - Nominate, constitute and appoint my friend and
relation Noah Felton, Sr. of Alabama, Leroy Monroe Felton and William H. Felton
Executors to this my last will and testament.
ITEM 12 - If the nieces do not want to participate (item 9)
in the division of the negroes, they can still take part in the
division of other property.
