WILL
Macon County, Georgia Will Book "A" page 252-257 MACON COUNTY, GEORGIA - In
the name of God -Amen. I, THOMAS S. MARTIN of Macon County, Georgia, being of
sound and disposing mind and memory, make this my last will & testament hereby
revoking & annulling all others heretofore by me made.
ITEM 1 - Direct that body be buried in Christianlike manner.
ITEM 2 - Just debts be paid with little delay.
ITEM 3 - Desire that Executrix shall support my bloved wife, Aurelia E. Martin &
her children by myself, to educate, until each child reaches 21 or marries,
provided that they stay under the care of executrix.
To do this, my executrix may rent lands, borrow money on lands, farm the land,
sell parts or contract, as she may deem best.
ITEM 4 - Make advances of money or property to children
becoming 21, to be deducted from their share at
settlement. Advances made to daughters, not to be subject to debts of their
husbands.
ITEM 5 - When youngest child by my wife, Aurelia E. Martin becomes 21, to sell
the whole of my real estate & personal property at public or private sale, after
sale, all debts to be paid, all remaining money be divided between my beloved
wife, Aurelia E. Martin and my surviving child or children. Share & share alike
EXCEPT that my daughters shall exceed the shares of my wife & sons by $500.00
each provided that the shares of my sons & my wife is not less than $2,000.00
each.
ITEM 6 - Desire that property be divided without sale mentioned in Item 5 if
agreeable. Each child to express their desire in writing, file with Ordinary of
Macon county, Executrix to consent to such agreement & carry into effect
according to law.
ITEM 7 - No real estate be sold until youngest child is 21 except it be found
necessary. Executrix is empowered to be the judge.
ITEM 8 - Executrix may buy or sell to make more convenient the task of dividing
estate.
ITEM 9 - Appoint my beloved wife, AURELIA E. MARTIN
Executrix this July 1, 1886.
ITEM 10 - Son, EDWIN J. MARTIN becomes 21 that he become joint executor with
wife. If Edwin J. Martin should die or not qualify, when my son Albert J. Martin
becomes 21 that he become joint executor. If wife is dead or unable to act, both
sons are executors or either to become sole executor if the other is unable.
ITEM 11 - Should wife, Aurelia E. Martin marry another husband before my
youngest child is 21, that she not be allowed to sell or purchase any real
estate for or belonging to my estate or change any investments or make any
settlements with my children as executrix without first obtaining an order of
Court for said purpose.

testament in the presence of us the undersigned who subscribed our names
hereunto in the presence of said testator at his special instance & in request &
in the presence of each other.

Thomas S. Martin Died September 21, 1886 Age 40 & is
buried in Marshallville Cemetery in Lot 3. Martin Family
There is NOT a marked grave for Aurelia Martin but next to
Thomas S. Martin there is an unmarked adult grave. She died after the 1920
census.
In 1880 Census Edwin J. 6 yrs. Albert T. 2 yrs. Baby Dau. 3 mo.
1900 Census Edward J.Martin 25, Albert T. Martin 22, Clara A. Martin 20, Susie
C. Martin 18.
