I, Wiley G. Higgins, Sen. being in my proper mind & in the decline of life, do hereby make this my last will and testament of all the property that I may be possessed of.
At my death, my wife, HANNAH HIGGINS, shall have her
choice whether to take a childs part or her dower. If she
chooses a child's part, my will to sell all property & divide.
If she chooses dower, sell the rest, pay just debts, burial
expenses, etc. then divide equally between my wife, Hannah and my daughter Elizabeth A. Shealy, daughter, Martha J. Peters' three Children, their Mother's part; Wiley
G. Higgins; Hannah M. Peack; James N. Higgins; Masoura
A Higgins; Eliz. A. V. Higgins; George W. Higgins & Mary A. M. Higgins.
My desire that at my death, Arris S. Newton should take charge of all my Estate, both real & personal & of disposing
of it at publick outcry and settling of all my just debts and burial expenses & to divide the remainder equally with my wife and nine (9) children as above named.

On March 20, 1854 I made my last will & testament and
I wish to make changes . I revoke and annul that portion
of will named in the twentieth line and second name mentioned in same line in lieu of her , at my death, drawing her equal share as the rest of Children, I give my daughter, Hannah M. Peak, wife of Oscar F. Peak and her children that she now has or may have, by present or future husband, my negro boy Umphrey, about 16 yrs old, worth $1,000. and at my death, my daughter, Hannah M. Peak
and her children to have enough of the ballance to make
her equal with the rest of my children. Arris S. Newton to
be Trustee of property. This January 22, 1858.
