In the name of God, Amen, I WILLIAM DYAS of the said state and county, being in
bad health and believing that I
will shortly depart this life, deem it right & proper as respect
both myself & family that I should make a disposition of the
property with which a kind providence has blessed me, do
therefore make this my last Will and testament hereby revoking all others
herefore made by me.
ITEM 1 - Desire my body to be buried in Christian like manner, suitable to my
conditions & circumstances in life.
ITEM 2 - Just debts to be paid without delay.
ITEM 3 - I desire that the settlement I immediately reside on
known as Lot No.114 [29th Dist.Orig.Lee,Now Macon Co.]
and half Lor No. 115 & half lot joining George Higgins No. not recollected.
remain undisposed of for the use and benefit of my four minor children for their
support & educat-
ion until the youngest is 21 years of age. viz. John Dyas
about 18 yrs. old, Quilla about 16 yrs old, also daughter
Margaret about 13 yrs old and Esther Parmelia about 12 yrs
old.
I desire that the above named minor children have the increase arising from the
land, and to be kept on farm, my
2 mules & black mare for the cultivation, half of my planta-
tion tools, two cows & calves, all my stock of hogs, one wagon & cart & yoke of
steers, all household & kitchen furniture, a sufficiency of provisions.
ITEM 4 - Residue of property, consisting of settlements
known as Goodner, Crumptin, also half Lot near Andersonville station and
adjoining Widow & Benj.Dykes.
ITEM 5 - I desire that the children of my son, Thomas J. Dyas, viz. Martha H.
Dyas, Wm. O. Dyas & Emma W. Dyas
should receive one tenth of my estate, deducting $210.00
which I have given their Father in his life time.
ITEM 6 - Son George to receive l/10 of estate Less $200.
ITEM 7 -Son John - 1/10 less $150 for a black mare & colt.
ITEM 8 - Son Quilla J. Dyas 1/10 less $150 mare & colt.
ITEM 9 -Dau. Sarah Ann 1/10 less $90 and provided a
home.
ITEM 10 - Dau., Mary E. Justice 1/10 les $95.
ITEM 11 - Dau. Nancy H. Dyas 1/10.
ITEM 12 - Dau. Martha E. Dyas 1/10
ITEM 13 - Margaret M. Dyas [does not say dau.]
ITEM 14 - Dau. Esther Parmelia Dyas 1/10
ITEM 15 - Executor to give proportional part to Grandchild-
ren mentioned in Item 5 & son, George to be Trustee.
ITEM 16 - Appoint son, George C. Dyas as Executor
ITEM 17 - Confidence in Son George to use his own dis-
cretion to dispose of property not set aside to my four minor
children.
