James Fielder's Will Dated
12/25/1812 Morgan County, GA In the name of God Amen. I James Fielder of the State of Georgia and County of Morgan being weak in body but perfect in memory calling to mind the transatory things of this life do make and ordain this my last will and testament in the words following. I leave to my beloved wife Sally Fielder all my Estate both Real and Personal for the proper use and benefit of herself and my children and at the experation of life or widowhood of my wife Sally Fielder I wish all my Estate both Real and Personal not herein mentioned to be sold and an equal division made amongst all my children . I leave it discretionary with my Executors to make a division at the coming of age of my youngest daughter Tempy Fielder if by consent of my wife Sally Fielder but not without her consent incase a division should take place before the experation of the life or widowhood of my wife Sally Fielder then I leave her a sufficient maintanance out of my Estate during the above mentioned terms to be excluded from said division til the experation of her life or widowhood and then to be equally divided amongst all my children my will is at the coming of age of my son Isham Fielder that my Executors give to him one horse, saddle and bridle, one cow and calf a! nd one feather bed and furniture and at the coming of age of my son Terrell Fielder, Betsey Fielder, Sally Fielder, Moriah Fielder, Tempy Fielder I leave each of them as they severally come of age, one horse, saddle and bridle, one cow and calf and one feather bed and furniture or the value thereof at the discretion of my Executors and my wife Sally Fielder and at the experation of the life or widowhood of my wife Sally Fielder or should she consent to a division then my will is that all my Estate both Real and Personal not heretofore mentioned to be equally divided amongst my then surviving children accept such as have deseased and left lawful heir or heirs shall receive their deseased Parents part of my Estate and should any of my children desease without a lawful heir of their body then their part of my Estate shall be equally divided amongst my then surviving children which is as follows to wit William L. Fielder, Thomas Fielder, Polly Few, John Fielder, Obadiah M. B. Fielder, Josiah Fielder, Isham Fielder, Terrell Fielder, Betsey Fielder, Sally Fielder Junior, Moriah Fielder and Tempy Fielder. I do so appoint and ordain William L. Fielder and Obadiah M.B. Fielder my Lawful Executors to this my last will and testament. Signed, sealed and delivered this 25th day of December 1812 in the presents of James Fielder (his mark and seal) Jos. Heard Harrison Jones Personally came and appeared in Open Court William Selman, Harrison Jones and Joseph Heard who after being duly sworn on the holy evangelist of almighty God deposeth and saith, that they saw James Fielder make his mark to the ? instrument in writing purporting to be the last Will and Testament of said James Fielder and heard him proclaim the same to be his last Will and Testament at which time they conceived him to be in sound mind and memory.
