Last Will and Testament of John Stovall

I , John Stovall of the County and State above named, being of sound mind and memory, and knowing that it is the lot of all to die, do make this to be my last Will and Testament, hereby revoking and annulling all former wills heretofore by me made.

And first, I will and desire that my body be buried in a decent and Christian like manner, and that my funereal expenses be paid out of my estate, and, as for what worldly property it has pleased God to bless me with, I will and dispose of if in the following manner.

Item 1: I give to my son George B. Stovall ten shares in the High Shoals Manufacturing Company, also, one forty acre lot of land, of which he has the title in his possession.

Item 2: I give and bequeath to my son James F. Stovall ten shares in the High Shoals Manufacturing Company, also one bed and furniture.

Item 3: I give and bequeath to my son William H. Stovall’s wife and his children, ten shares in the High Shoals Manufacturing Company. If it is her wish to exchange the shares in Factory Stock for land, she is privileged to do so. I also give them one bed and furniture and my buggy and harness.

Item 4: I give and bequeath to my daughter Mary E. Harris and her children sixteen shares in Georgia Rail Road Stock, also my parlor furniture and also one bed, bedstand and furniture of her own selection.

Item 5: I give and bequeath to my son John W. Stovall ten shares in Georgia Rail Road Stock, also my Plantation on which I reside, consisting of about three hundred and seventy five acres of land, together with all the improvements and appurtenances thereon, also, the stock of all kinds, and farming implements belonging to the farm, also one bed and furniture. If there be more bed furniture than enough to supply each bed, as mentioned in the items above, I desire any children above named to divide it among themselves.

Item 6: I give and bequeath to my grandson William E. Stovall four shares in Georgia Rail Road Stock, which formerly belonged to my wife, also, if there is any money left after my expenses are paid, I also desire that he have it. I desire that my son George B. Stovall take charge of what I have given my grandson William E. Stovall and manage it for him.

I hereby appoint my two sons George B. Stovall and James F. Stovall, my lawful executors to execute this my last will and testament. (Interlined before assigned)

At chambers, before me came for the purpose of proving the last will and testament of John Stovall, late of said County, deceased, Joseph Few, Sr., one of the witnesses to said will. The will having been brought before me for probate by the executor George B. Stovall, who has filed his petition for probate of the same in common form of law. Here, the said witness deposes and says, that he saw the said John Stovall sign and publish the same as his last will and testament on the day and year then stated as executed by him. That he witnessed the same as his request, in his presence and in the presence of F.W. Prior and B.F. Carter, who also witnessed the same at his request and in his presence, and in the presence of myself and each other, that the same was voluntarily executed by him while he was of sound and disposing mind and memory.
