WILL OF WILLIAM MITCHINER

_____ Sarah Mitchiner shows that she is the widow of William B. Mitchiner late of said county deceased who died _____ will in which David Rumple and John H ________ Executors that said Executors fail _____ qualify that there is a considerable estate _____ she _____ letters of administration may be _____ her with the will annexed

Before me William D Liddor Ordinary of said county in open court came William W McNeil adminstrator with the will annexed of WM B Mitchiner late of said county deceased and produced before me the last Will and Testament of said Wm B Mitchiner deceased and James H. Harden one of the witnesses to said will of which witness being sworn deposes and says he saw Wm B Mitchiner the Testator sign, seal and declare and publish the instrument now presented as his last Will and Testament, freely voluntarily and of his own accord; and without any compulsion or influence whatever; that at the time of the execution of said Will said Testator was of sound and disposing mind and memory; that despondent signed said will as witness and saw F M Duke and H C Jenkins sign the same as witnesses in the presence of the Testator and at his instance and request. sworn to & subscribed before me this Dec 3 1866

In the name of God amen. I William B Mitchiner of the county of Randolph State of Georgia being of sound & disposing mind and memory and being desirous to settle worldly affairs while I have strength so to do; do make and publish this my last Will and Testament. Hereby revoking all wills by me at any time heretofore made.

And first I commit my soul to God who gave it and my body I desire to be buried in the family burial ground at Benevolence Church and my worldly estate I dispose of as follows

Article 1st – I give and bequeath to my beloved wife Sarahmy nergo man Boly of light complexion, my negro boy Bob of dark complexion, my negro boy Washington of light complexion, my negro boy Aamon of dark complexion; my negro woman Lutisher of light complexion; my negro girl Elizabeth of dark complexion; my negro girl Mary of dark complexion; my negro girl Emma of dark complexion; my negro girl Ella of dark complexion, my negro child David of light complexion; my negro woman Lucy & her three children, by name Evan a girl; Bartow a boy and Anola a girl Also a negro girl by name Ducsy

Article 2nd – I give bequeath and devise to my beloved wife lot of land whereon I now reside containing two hundred two and a half acres (202 1/2) A lot of land in the 10th District of Randolph County known and distinguished in the plan of said district by number one hundred and fourty three (143)

Article 3rd – I give and bequeath to my beloved wife in the same unreserved manner the following property to wit The horses, Mules, Cows, Hogs, Bees, Poultry, Buggy and Harness, Saddles, wagon, Gin, Fan, threshing machine, Farming utensils, leathers, household & kitchen furniture of every description also the present growing crop

Article 4th – I give and bequeath to my daughter Amanda Craps wife of Wade Craps for her sole & separate use for and during her natural life, free from the debts or liabilities of her present or future husband the following property to wit My negro woman Harriet about nineteen years of age. The property in this article contained (at the death of my daughter Amanda Craps) shall pass to and become the property of the children and representatives of children of said Amanda forever.

Article 5th – I desire the following named lands – a tract of one hundred and sixty acres joining lands of Managers Mr Sharpe, Coleman & Duke known as the Turner place five hundred acres being in Screven County – on Horse Creek; ninety four acres lying in Irwin County Greogia (see records in Screven county & also an interest in the Guabret estate as an heir to be sold & the money to be appropriated to the payment of my lawful debts

Article 6th – I desire all the notes and accounts to be collected & applied to the payment of my debts; If there not a sufficiency set forth in Article 5 & sixth to pay my lawful debts the property or a sufficiency mentioned in the seventh Article shall be used for that purpose

Article 7th – I give a bequeath to my son John H; my daughter Mary W wife of David Rumple, my son Thomas W, my daughter Elizabeth H, wife of George W King; my son Raymond R, my daughter Sharlotte L Pool, wife of William Pool the following named negroes; Ritter a woman about sixty six years of age; Sallie a woman about fourty five years of age; Marshal a man about fourty three years of age; _____ a woman about fifty years of age; _____ about nineteen years of age; Silva a woman _____ years of age; Green a boy about sixteen years of age; _____ a woman about thirty seven years of age; _____ a girl about eleven years of age. Melissa a girl about nine years of age. Raymond a boy fifteen years of age. Willie a boy three years of age to be equally divided among the above named heirs after the debts have all been paid

Article 8th – I give and bequeath to my son Robert H, my son David A my two shot guns

Article 9th – I hereby constitute and appoint my son John H Mitchiner & my soninlaw David Rumple Executors of this my last Will and Testament this 29th day of May 1865

Signed, sealed, declared and published by William B Mitchiner as his last Will and Testament in the presence of us the undersigned who subscribed our names hereto in the presence of said Testator at this special instance and request and in the presence of each other
