WILL OF SAMUEL STAMBAUGH Contributed today by, Marilyn Mcguire
23thd day of April AD 1896.
I Samuel Stambaugh of Bertram township Linn County Iowa, being of sound mind and memory, and desirous of making a disposition of my personal property in manner as to me seems just and proper.
Therefore, I make and publish this as my last will, hereby revoking all former wills.
I give and bequeath all my personal property including any notes, accounts or money, that I may own at the time of my decease, in the following manner to wit: It is my will that the Doctor's bill if any for my last sickness, the funeral expenses, and costs of administration shall be paid first.
second. To my beloved wife Rachel Stambaugh, I give and bequeath one third in value of the remainder of my personal estate.
The remaining two thirds in value I give and bequeath unto my nine children whose names are as follows. Mary A. Stoneking, Louisa Cary, Samuel B. Stambaugh, Noah B. Stambaugh, James A. Stambaugh, Rachel J. Lamson, George W. Stambaugh, Albert H. Stambaugh and Martha Eva Berry.
I further will and direct that all my personal property be duly appraised and that my wife Rachel Stambaugh select in kind if she so elects one third in value of the remainder after the aforesaid claims have been paid That the remaining two thirds be sold at public auction, and the proceeds thereof divided equally among my children herein named.
I appoint and constitute my two sons James A. and George W. Stambaugh both residents of Bertram township Linn county, Iowa, executors of this my will. I authorize and empower my executors to collect all rents and claims due or to become due, as rentals of my farm until the decease of the testator and his wife Rachel Stambaugh. My executors are authorized to furnish out of the rents unto my wife Rachel stambaugh all necessary clothing, and medicines (that one of her age may require) during her lifetime. I will and direct that my executors erect or cause to be erected at my grave and my wife's grave head marks properly lettered giving date of birth and death of both. The headmarks shall correspond with the monumnet now erected on my burial lot in "the Campbell cemetery".
My real estate was divided among my nine children by warranty deeds bearing date February 4th 1895 and said deeds are to be in force and effect upon the death of the grantors thereto.
In witness whereof I have signed sealed and published and declared this instrument as my will, executed at my residence in Bertram township Linn Co Iowa this 23thd day of April AD 1896.
We the undersigned do hereby certify the the testor Samuel Stambaugh at his residence in said township county and state signed and sealed this instrument and published and declared the same as and for his last will. And we at his request and in his presence and in the presence of each other have hereunto written our names as subscribing witnesses and that he was of sound mind.

I, J. W. Bowman, Clerk of the District Court, in and for said County, do hereby certify that on this day at the October Term, A. D. 1897, of said Court, the Will and Instrument in writing hereunto annexed, and bearing date on the 23d day of April 1896 was duly proved before and allowed by said Court as and for the last Will and Testament of the real and personal estate of Samuel stambaugh late of said County, deceased, and was by said Court ordered to be recorded as such Will and Testament.
In Witness Whereof, I have hereunto set my hand and affixed the seal of said Court, at my office in said County, this 19th day of October A. D. 1897,
