Will and Testimony of William Murphy:
I, William Murphy, of the County of Warren in
the State of Illinois do make and publish this my last will and Testament in
manner and form following , that is to say First, it is my will that my funeral
expenses and all my just debts be fully paid.
Second I give desire and bequeath to my beloved wife Nancy Murphy in lieu of her
dower, the plantation on which we now reside, situate in the County of Warren
and described as the West half of the East half of the North East quarter of
section eighteen in a Township Eleven North of Ranges one west of the fourth
principal meridian containing about forty acres of land during her natural
lifetime and all the household furniture, together with all the beds and bedding
which are to be at her disposal either during her life or at her death.
Third, I give and bequeath to my son, John E Murphy, the Plantation above
? on which we now reside at the death of my said wife
Forth; It is my will that my executor dispose of all my personal property
immediately after my death on a credit such as he may think best and pay all my
just debts and funeral expenses out of the proceeds of said sale and that the
over plus if any be equally divided between my three children now living and one
equal portion to be divided between the children of my late daughter, Elizabeth
Deweese, and that all the land of which I may die seized except the tract above
described shall be left in the care of my executor to be by him ,divided among
my three surviving heirs or to be sold and the proceeds divided among my said
heirs and the children of the said Elizabeth Deweese, but in case of a division
of the land among my surviving heirs the whole of said lands to be valued, And
one forth part of the value thereof set part to the use of the children of the
said Elizabeth Deweese to be paid to them as they shall become of lawful age ,
in other property by the surviving heirs.
And lastly I hereby constitute and appoint my son in law, Elijah Davidson, to be
the Executor of this my last will and Testament, and my son, John E Murphy, and
my son in law, Thomas C Wallace, to be his advisors revoking and annulling all
former wills by me made and ratifying and confirming this and no other to be my
last will and testament
In testimony whereof I have hereunto set my hand and
seal this 13 th day of Nov 1844
