Samuel Burns

The 1820 Grant County, Kentucky Census shows Samuel Burns was born between 1775-1794; his father unknown. His wife, Eve, daughter of John Martin and Elizabeth Lail Franks, was born between 1794-1804, according to the same census. Samuel served in the War of 1812, Captain Childers' Company, Kentucky Mounted Volunteer Militia, commanded by Colonel William Mountjoy. According to the account in Dr. Anderson Quisenberry's book, Kentucky in the War of 1812, this company originated in Pendleton County, and all of the officers of this company were from this county. The 18th century militia allowed men to elect their officers, so this company would have elected men from the same area as themselves. Also, when this regiment was discharged at Newport, Childers' Company had to only travel 50 miles to muster out. This would also place their residence in the Pendleton County area. Samuel was mustered out September 16, 1813.

Samuel Burns and Eve Franks applied for a marriage license September 5, 1816 in Switzerland County, Indiana, stating they were both of Kentucky and produced an affidavit that they were both of the age required by law to marry, without the consent of their parents. They were the parents of three children: James, Betsey and David.

At the time of Samuel's death in Grant County, February 1823, he was living on the old place of John Martin Franks. Samuel died without a will, so administration was granted to Jacob Franks on his estate, whereupon Jacob took the oath required by law and executed bond in open court in the penalty of $400, with John Franks his security.

The property of Samuel Burns was sold February 20, 1823. His estate settlement was April 8, 1826 and included receipts from Edward Armstrong, H. Smith, David Tully, William Hutchison, Eliza McIntere, Elizabeth Franks, Nelly Lail, Stern Kendall, Thomas Simson, Joseph Myres, John Franks, Elizabeth Hutchison, John Sipple, Charles Sechrest, David Burns, Samuel Burns, William Franks, John Miars.

On July 23, 1825 it was received of Jacob Franks, administrator of the estate of Samuel Burns, the sum of $91.95, it being the amount of overplus which was overpaid to said Samuel Burns as a legacy of John M. Franks, deceased, which sum or overplus paid through mistake as administrator of said John M. Franks' estate, his part not amounting to the amount I paid him, by that sum agreeably to a settlement made by me with the commissioners appointed by Pendleton County Court in March last, and the amount paid by me to said Burs being $202.78. Eve's year of death is unknown, but records show it was prior to October 1825. After the death of Samuel and Eve, James and Betsey lived with their Grandmother Franks as long as she kept house. An indenture of apprenticeship was made the first day of January in 1830 that James Burns, aged thirteen years next April, by and with the consent of his guardian, William Franks, and of his own free will, placed and bound himself apprentice to Charles Secrest Jr., stonemason, of which trade the said Secrest now uses.
