In the name of God Amen. I, James Collins of the County of Grant and State
of Kentucky being infirm in body but in my proper or right mind and recollection
for which I am grateful to God whose mercies have ever been extended toward
me, notwithstanding which I call to mind the mortality of the body that it
is appointed that we must die for that all have lived, I do therefore make
and ordain this my last will and testament, that is to say, first of all
I would resign my soul into the hands of God to whom I hope it doth belong
and my body to its mother earth there to be decently interred at the discretion
of my executor under named and as touching such earthly goods or estate as
God hath pleased to bless me with in this life, I to demise and dispose of
the same in manner and form following.
First, that of my personal property to be sold at public auction at reasonable credit for the payment of all my just debts, if the proceeds thereof should not be sufficient (as I feel it will not) for the payment of my debts that so much of my land as it may require be sold so that my debts be fully adjusted.
Next I will and bequeath to my son, John Ashbrook Collins, the remainder of my land in which I wish and will that my helpmate in this life, Rachel Collins, my wife, may have her dower or ample maintanence during her natural lifetime.
Third, that my executors pay to James Wm. Singleton, eldest son of my daughter Louisa Collins (alias) Singleton the sum of five hundred dollars on or before the expiration of two years from the settlement of my debts as above, and,
Fourth, also to pay over to my daughter, Louisa Singleton's other children, Mary Elizabeth Singleton and John Collins Singleton the sum of two hundred and fifty dollars each to be paid to them when they arrive to the age of twenty-one years which respective sums as named above to the heirs of my daughter, Louisa Singleton, with the portion their mother and father, Samuel F. Singleton, had heretofore received or drawn amount to the full and equal division of my estate after the settlement of debts and provision for my beloved wife as already named and some ten years labour and toil with me in y difficulties rendered by John A. Collins is compensated or settled out of my estate.
And lastly, I do will constitute and appoint my son, John A. Collins and his successor my lawful executor to carry this my last will and testament in into full execution and most fully adjust all my concerns that my come under his or his successor's notice as well as the above for the accomplishment of which I do by these presents vest him with power to receive and make conveyances of title for lands as the case may be, the same to be of ___ as if done with my own hand. This last will and testament of James Collins, deceased, was produced
in open court on the 13th day of March 1848 and proven by the oaths of William
Conrad, Robt. Gibson and Benjamin F. Dickerson, subscribing witnesses thereto
to be the act and deed of the said James Collins, deceased, which being examined
and approved by the court was ordered to be recorded, whereupon said will
is duly recorded in my office this 31st day of March 1848. E. H. Smith,
