In the name of God Amen. I, Jane Daniel, being of sound mind and disposing memory, but knowing the uncertainty of life do make and ordain this my last will and testament, hereby revoking all other wills and writings, testaments heretofore by me made and exceeded them.

First, I will and desire to Henry Daniel of Mount (blank) Kentucky as trustee of all my estate, both real and personal to be managed by him for the use and benefit of these thereafter mentioned and reposing? special confidence in him that he will manage the estate according to my will and desire. I give to him power to sell and dispose of the property and estate as he may deem best calculated to carry into affect this my last will and testament.

Second. I will and bequeath all the personal property whereto I may own at my death, Negroes excepted, to my niece, Minerva E. Edgar, as she has been kind and attentive to me in sickness and in health, and also a little Negro boy by the name of James, the son of Susan, who has been sick and is yet sick and as to the raising of the child, has dovolved? on my niece, it is my special desire that said boy shall be owned and enjoyed by her, and one-third part of my slaves I give and bequeath to my said niece, Minerva E. Edgar and all the above property willed to her for her use and benefit to be managed and controlled by him, my said trustee.

Third. It is my wish and desire that Samuel Herndon, Elizabeth Herndon, Margaret Herndon and Leyda Ann Herndon, now Leyda Washington, children Samuel G. Herndon's first wife, Louisa, have one-third part of all my slaves, ___ excepted already divided to Minerva E. Edgar, to be under the control of my said trustee to be managed and disposed of by him.

Item 4. It is my will and desire that Nancy Mileon, daughter of my brother Beverly, deceased, have the other third part of my slaves, ____ excepted or devised to my niece Minerva E. Edgar to be under the control and management of my said trustee to be disposed as he may think proper.

Item 5. I do hereby appoint Henry Daniel my executor and request the court not to require security of him either as executor or trustee.

Item 6. It is my will that my executor divide the Negroes amongst the devises agreeably to his best judgment and in no instance to separate man and wife, and should any one of the slaves desire to be sold in the neighborhood of his wife or her husband, then it is my positive direction that he or she be sold to someone whom he or she may select and if he or she cannot be sold at a fair price, then he or she is to be sent out in the neighborhood of his wife or her husband until such sale can be effected. Given under my hand and seal this 5th day of June 1852 (or 1853).

I certify that the foregoing will of Jane Daniel was produced in open court and proven by C. Holton, one of the subscribing witnesses and he, the said C. Holton, proved that V. R. Washburn, the other subscribing witness, witnessed the same by the request of the said decedent which was received and ordered to be recorded. Given under my hand this 26th of October 1853. Signed H.
