In the name of God Amen. I, William Dehart of the County of Grant and
State of Kentucky being sick and weak in body but of sound mind and memory
and understanding, do make and publish this my last will and testament in
manner following, to wit: Principally and first of all I commend my immortal
soul into the hands of God which gave it in the firm hope of happiness in
eternal life, merits and faith in the revealed promises of Jesus Christ,
my Lord and Savior, and my body I commit to the earth to be buried at the
disposal and discretion of my surviving friends, and as to such worldly estate
not otherwise heretofore by now disposed of when with it that pleased God
to bless me in this life, I give and dispose of the same in the following
manner. First it is my will and I do order that the bills of my physicians
and my funeral expenses be duly paid and satisfied as soon as conveniently
can be after my decease.
Item. I give and bequeath to my son, Daniel Dehart, my rifle gun now in his possession.
Item. I give and bequeath to my son-in-law, Samuel Williams, the sum of fifty cents, and to my daughter, Nancy Williams, consort of the said Samuel William, both of Harrison County in the state aforesaid a like sum of fifty cents to be paid to them in money by my executor after my decease, and thence made for the ____.
Item. I give and bequeath unto my beloved wife, Elizabeth, the entire right, tittle, interest, value and ___ of it will to the recovery, receipt and us of the following named bills receivable together with the several amounts of money due or payable thereon, one due bill drawn payable to me by Allen B. Godman in the sum of $300 dated December 16, 1844. One other obligation and promissory note drawn payable to me by the Allen B. Godman in the sum of $85 dollars dated November 4, 1845, and one other due bill drawn payable to me by James Conyers in the sum of $100 dated November 6,1845. This last bill is entitled to the credit of $40 dollars made in two payments of $20 as marked on the bill leaving a balance due on the principal of $60.
Item. I give and bequeath to my said wife all the following enumerated personal property or articles or under whatever names the law may define this, to wit: Cash on hand $17.50, my boy mare now in her possession, one high post bedstead, two feather beds and the clothing and furniture belonging to the same, one bureau with book case, two trunks, two riding saddles, one for a man and one for a woman, two riding bridles.
Item. I do moreover give and bequeath to my said wife the sum of $15 due to me from John F. Smith of Harrison County, state aforesaid, money at his ____ and for his use with which I supplemented William Tollough? to carry a mare to Sarah G. Smith, then in Arkansas, in addition hereto for the lack of convenience I have left in the hands of my wife my written order,
And lastly, I nominate and constitute and appoint my said wife, Elizabeth, to be the executor of this my will, hereby revoking all other wills by me heretofore made and declaring this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal the 29th day of July in the year of our Lord 1846. William Dehart. October Term 1846.
I, Wm. Smith, Clerk of the County Court for said
county certify that this last will and testament of William Dehart was produced
to court at the same above and proven by the oaths of W. H. Simpson and Perry
Simpson, subscribing witnesses thereto to be the act and deed of the said
William Dehart. Whereupon the same also ordered to be recorded which is
accordingly done in my office this 3rd day of December 1846. Attest: William
