In
the name of God Amen! I, Francis C. Gaugh of Grant County and State
of Kentucky, being weak in body and afflicted, yet in my right mind, possessing
all my mental facilities and feeling desirous of disposing of my worldly
goods and all the property I possess, both real and personal, so that after
my decease, peace and concord may continue in my family, and each member
then may know and obey my wish relative to my estate, do hereby make and
ordain and caused to be made and ordained, this my last will and testament,
to wit:
Item First. I wish and desire all my just debts to be paid by my executor after my decease, out of any personal property that can be most easily disposed of by her. I thank God my debts are few and small and will not give any one much trouble.
Item Second. I wish and desire that my dear and beloved wife, Mary, shall occupy, use, cultivate, or rent out my place during her natural life or widowhood for her own comfort and happiness, and the raising and educating of my younger children, now minors and under her care, whose natural guardian she is and whose legal guardian I desire her to become. I also desire her to have and keep for her own use and comfort, welfare and support of my said minor children all my horses, hogs, sheep, cattle, poultry and grain, together will all my household and kitchen furniture, except $100 hereinafter otherwise bequeathed.
Item Third. At my wife Mary's death or marriage I wish and desire that my land shall be sold in a body or in seven parts as my children living at the time may elect. My son, John W. Gaugh will come in for no part of my land, inasmuch as I have this day conveyed to him by deed the tract of land I purchased off James Wilson, the same being 50 acres more or less which is to be his share of my lands. So then at my wife's death or marriage, I desire my land to be divided equally (regarding both quantity and quality) among my following named children, to wit: my daughter, Elizabeth Ann Sheriff, wife of Andrew Sheriff, Letitia Catherine Simpson, wife of Morgan Simpson, Nancy Jane Vance, wife of Robert Vance, and my two sons, Gilby K. Gaugh and Francis M. Gaugh, and my two single daughters, Mary Ellen Gaugh and Sarah W. Gaugh, each to have one-seventh part of said land regarding quality as well as quantity.
Item Fourth. Before any general division is made of the personal property that may remain on hand at my wife's marriage or decease, I wish Mary Ellen Gaugh, Sarah William, and Francis Marion Gaugh to have one bed each; Mary Ellen is also to have one cow, five head of sheep, and a Bureau; Sarah William one cow, five head of sheep, a bureau and a saddle; Francis Marion is to have the "Brown Filly" or? her value saddle and bridle, and Gilby K. Gaugh is to have paid to him as soon after my decease out of personal property that may be most easily spared by my wife $100 in cash, and I also give a cow apiece to Gilby K. and Francis Marion Gaugh. These special gifts are made to make my children all as equal as it is in my power to do. After these are paid out whether in kind, or at their value in money, then I wish the remainder of all my personal estate to be equally divided among and between my eight children named in this will or to their heirs.
Finally, I nominate and appoint my wife Mary my sole executor to carry into effect this my last will and testament. In testimony of which I have hereunto set my hand and seal this 27th day of August 1857. Signed F. C. Gaugh. Att: David Boys, B. Dunn, B. N. Carter.

Court November Term 1857.
The foregoing
last will and testament of F. C. Gaugh, deceased, was produced in open court
at the term above stated and offered for record, which after being read and
examined was proven by the oaths of B. N. Carter and David Boys, attesting
witnesses, to be the act and deed of F. C. Gaugh. Whereupon the same with
this certificate is duly recorded in my office this 17th of November 1857.
