In the name of God Amen. I, Lewis Hensley of Grant County being feeble
in body, but of sound mind and calling to mind the uncertainty of frail and
transitory life and the certainty of death do make this my last will and
testament.
First. After my decease I will and direct my executor hereinafter named to pay all my just debts.
Second. I will and bequeath to my beloved wife, Clarissa, as out of such personalty (as shown) as I may have at the time of my decease all the property which is now by law exempt from distribution and in addition thereto our house to be selected by her for and during her natural life.
Third. I will and direct my said executors to sell all my personal property not herein specially devised and that the proceeds arising from, together with all the money on ____ or that my come to their hands they loan out at interest from time to time upon such terms as they may deem best, after however paying my just debts as before provided during the natural life of my sid wife, paying to her the interest arising therefrom as they may collect it from time to time to be used by her at her discretion, but the principal I wish to remain in their hands to be disposed of as above directed until her death.
Fourthly. I will and bequeath unto my said wife for and during her natural life all my real estate.
Fifthly. After the death of my said wife, I will and direct my said executors to sell all the real estate herein devised to my said wife during her life and so much of their personalty so devised as may be remaining at her death ,on such creditors they may deem most _____.
Sixthly. After the death of my said wife and until my sid executors shall have collected all the outstanding debts arising from the sale of lands or otherwise, I wish them to loan at interest all the money which they may have on hand or that may come to their hands from time to time or otherwise.
Seventhly. The fund thus raised I wish divided equally among such of my children as my be living at the time of my decease, except my daughters, Martha Greenwell and Fanny Watson. In case my said daughters or either of them shall survive me, I wish each of them or such one of them as may survive me, should one of them die before if do, to have the use and benefit of an equal share of said fund with all my said children who may survive me, and I hereby will and devise to my son, George S. Hensley in trust for their use and benefit to each of them or such one as may survive me and equal share of all said funds with such of my children as may be living at my death to be appropriated and disposed of for their benefit as he may think will best to advance their interest and welfare that is I wish said fund devised equally amongst such of my children as shall survive me excepting that the part designed for such of my said daughters as may survive me, I bequeath to my said son, George S. Hensley in trust for them as above provided.
Eightly. I hereby appoint my son, George S. Hensley and my friend, W. S. Rankin, my executors to operate and carry out this my last will and testament hereby revoking all other will or wills heretofore made by me, this 28th day of November 1853. Lewis Hensley. Codicil: Being of sound mind and memory but frail in body I desire to hereby make this codicil to the foregoing my last will and testament executed by me on November 28, 1853.
First. I will and bequeath to my wife my buggy for driving her natural life.
Second. After the payment of all my debts I wish my executors to appropriate forty dollars to the American Missionary Society under the control and _____ of the Methodist E. Church South.
Third. I wish my said executors after the payment of all my just debts out of my estate to appropriate ten dollars to the ____ of Sowers meeting house in Owen County.
Fourth. I hereby authorize and empower and authorize my said executors or either of them to make and comprise of compromises of any claim or claims that have been or may hereafter be set up against any part of my real estate, which they may deed advisable and proper in order to serve the title to the same and protect and ____ the interest and welfare of my wife and heirs and to execute any deeds or other written instruments which may be required to perfect and complete any such compromise or compromises this 8th day of April 1854. The last will and testament of Lewis Hensley, deceased, was produced in
open court and proven by the oaths of Squire Lucas, Seth Doud, and W. S.
Rankin at the term above stated which is admitted to record this 3rd of January
