I, Joel B. Hume, being of sound mind and in the perfect employment of
my reason, but greatly afflicted in body with a terrible disease and taking
into consideration the uncertainty of human life at all times, but particularly
situated as I am now, do make this my last will and testament. I do herein
the first place give and bequeath to my beloved wife, Mary H.? Hume, all
my estate real or personal, money or property of any and every description
of which I am now possessed or to which I have in any way entitled after
fully paying my just debts, to have and to hold the same absolutely in her
own right so long as she shall remain a widow and I hereby constitute and
appoint her my said wife, Mary H.? Hume, my sole and only executor and it
my will and desire that no security shall be required of her by any court
before when this my last will and testament may be proven or by any other
court in the settlement of my estate as executor as aforesaid, but upon the
happening of the event of her marrying a second time, it is my will that
all my property of every description be equally divided among my children,
with the exception of the one third to which she is entitled by law, which
it is my will that my said wife shall have full power while she remains a
widow, as aforesaid, to divide my aforesaid estate or property among my children
in such manner as she may judge right and proper.
And it is my will further that my wife shall sell any or all of my Negro slaves if she shall not be able to manage them, and shall at any time desire so to do and in the event of her selling any of them, it is my will that the proceeds shall be put by her in some bank at interest and that the interest derived from the same shall by expended by her in educating my youngest children.
In the settlement of all the estate of Peter Ireland, I am the administrator and I desire that the court will receive in my place and stead Andrew S. Lin. In witness whereof I have hereunto set my hand and seal the 12th day of November in the year of our Lord 1849 at the City of Covington. Joel P. (X) Hume. 1850.
This last will and testament of Joel B. Hume, deceased, was produced in
open court at the term above, stated and proven by the oath of G. W. Cutter
one of the subscribing witnesses thereto who also proved that the other
subscribing witnesses subscribed the same in his presence and in the presence
of the said Hum and at the request of the said Hum and ordered to be recorded
whereupon the same is duly admitted to record in my office. Given under my
hand this 26th day of April 1850. William Smith, Clerk by E. H. Smith, Deputy
