161 In the name of God Amen. I, William Layton, of the County of Grant and State of Kentucky being weak of body but of sound and disposing mind thanks be to God do constitute and make this as my last will and testament to wit: First I give and recommend my soul to the hands of Almighty God that gave it and my body I recommend to the earth to be buried at the discretion of my executors who may here after be appointed. Hoping that I shall receive again at the great day of the Resurrection; as as touching worldly concerns with which it hath pleased God to bless me, I give and dispose of it in mann and form following to with: Item the first, I give to my son Darius Layton a bed and furniture and a cow and calf and my silver watch to him and his heirs forever. Secondly, I give and bequeath to my son Spencer Layton a bed and furniture and a cow and calf to him and his heirs forever. Thirdly, I give and bequeath to my daughter Betsy Layton a bed and furniture, a cow and calf, one bureau and side saddle to her and her heirs forever. Fourthly, I give and bequeath to my daughter Hester Ann Layton a cow and calf, a bureau, bed and furniture, one side saddle and one three year old horse colt jack to her and her heirs forever. Fifthly, I give and bequeath to my son Darius Layton the tract of land whereon I now live containing two hundred acres, but he is not to have possession of that part of the tract which lied north of Crooked Creek in the County of Grant during his mother's life as she is to have her lifetime estate in it. But after my decease he may take possession of that part of the tract which lies south of Crooked Creek and in the County of Harrison and the balance after the death of his mother to him and his heirs forever. Sixthly, I give and bequeath to my beloved wife Major Layton for and during her natural life all that part of my tract of land which I now live on which lies on the north side of Crooked Creek in the County of Grant together with the appurtuances thereon together with all and singular the whole of my household and kitchen furniture, my stock horses, cattle, sheep and hogs of all and every kind and description whatever for and during her natural life. Seventhly, I give and bequeath to my sons Cyrus and Spencer Layton each one hundred and fifty acres of my land lying in the State of Indiana to them and their heirs forever. Eightly, I give and bequeath to my daughters Betsy and Hester Ann Layton to each of them fifty acres of land which I hold in the State of Indiana to them and their heirs forever. Ninethly, I give and bequeath to my son, Cyrus Layton, to my daughters Rebekah Polly and Peggy each one dollar specie having heretofore provided for them otherwise to them their heirs forever. Tenthly, I give and bequeath to my granddaughter, Ann L. Williams, one bed and furniture and one cow and calf to be paid to her after the death of her grandmother, or sooner if her grandmother sees fit to her and her heirs forever, it being her mothers full part of my estate. I also give and bequeath to my grandson, Wm. M. L. Hardy, two dollars specie, it being his mothers full part of the estate to him and his heirs forever. It is my further wish and full intention that after the death of my beloved wife that the estate which she may leave which is not otherwise disposed of be equally divided between the whole of my children for the use of them and their heirs forever. And lastly I hereby nominate constitute and appoint my beloved wife, Major layton, my executrix and my sons Darius and Spencer Layton executors to carry this my last will and testament in full execution. Hereby ratifying and confirming this my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal this 21st day of April 1826. William (X) Layton.
