In the name of God, Amen, I, John Lowe of the County
of Grant and State of Kentucky, being in ill health but in my right mind
and yet retaining usual soundness and judgment together with my proper
recollection, and knowing the frailty of human nature as well as the certainties
of God's appointment of all flesh to return to dust again, that I do ordain
and appoint this my last will and testament.
First of all I commit my soul and spirit to God
who gave it and my body to the grave there to be decently entered.
Secondly, as to my earthly goods and chattels I do appoint and wish that of them first all my debts be paid if any remain unpaid at my decease, after being first sold at a credit of twelve months.
Third, my farm and lands, I wish to be sold to the highest bidder and payable in twelve months after the sale, the other two-thirds in two annual payments or as my under named administrators may think most advantageous to my heirs and the whole of the money as fast as collected after my debts is paid to be put out on interest and that my two sons, John Sanford and William Morehead Lowe, have a liberal education of the above, and that my daughter, Elizabeth Margaret, with my above named sons as they become of age to draw their equal and proportionate part of the proceeds of said estate that may be left in money after allowing said Wm. Morehead twenty dollars in case no saddle is gotten for same by my administrators for said son before he arrives of age of said price seeing I have already gotten one of said price for my son, J. Sanford Lowe. I will and wish my daughter, Margaret, to have one bed and bed clothing in addition to the bed her sister gave her and same to be exempt from sale and without valuation.
Further and lastly, I do appoint William Conrad and Horatio Marksberry Lowe my sole and only administrators vesting them not only with power to transact and adjust my affairs as above, but also in my room and stead to make sales, receive and convey bills as the case may require the same to be lawful as done with my own hand. I, H. B. Smith, Clerk of the county court of the
county aforesaid certify that this will of John Lowe, deceased, was produced
to the Grant County Court at the March Term 1840 and proven by the oaths
of T. J. McGinnis and John L. Glasscock two of the subscribing witnesses
hereto and ordered to be recorded which is accordingly done. H.
