In the name of God Amen. I, John C. Masterson, of the County of Grant
and State of Kentucky, being of sound mind and memory but weak in body and
knowing the uncertainty of life and the certainty of death, do make and ordain
this my last will and testament, to wit: in the first place after all my
just debts and funeral expenses are paid, I give and bequeath to my beloved
wife, Mary F. Masterson, all my stock of every kind, my farming utensils,
household and kitchen furniture, and likewise I give and bequeath to her
all my landed estate to have and to hold during her natural life, and after
her death, I give and bequeath it to my six children by my last and present
wife, to wit: Nancy Margaret Masterson, Sarah Thomas Masterson, Elizabeth
Masterson, Frances Masterson, Ann Patsy Masterson and Joanna
Masterson.
Item. I give and bequeath to each of my two married daughters, to wit: Arian Stewart, wife of Purnell Stewart and Janetta Price, wife of Joseph Price, one dollar, having heretofore given to each more than I am now able to give to each of my other children.
Item. I give and bequeath to my daughter, Mary N. Masterson, five hundred dollars out of the first money of mine that may come into the hand of my executors hereinafter named.
Item. There will shortly be coming to me from my mother's estate a tolerably large sum of money which money I will and desire my executors to lay out in land in some place that will be as consecutive to my present residence as practicable which land so purchased, I desire shall be deeded to my six daughters, to wit: Nancy Margaret, Sarah Thomas, Elizabeth Frances, Ann Patsey and Joanna, an equal part to each according to quantity and quality, after my executors shall have first laid off to my daughter, Mary N. Masterson one hundred and fifty acres of said land which I hereby give and bequeath to her.
I purchased of James Masterson and Lovitt Ann Jeter, late Masterson, children of my late brother, Lovitt Masterson, sixty odd acres of land being part of the farm on which I now reside, and for which I obtained their title bond and paid one hundred and fifty dollars, the balance of the purchase money will be due shortly about one thousand dollars. Now as my brother-in-law, William Metcalfe, is more acquainted with this particular business than my executors, I desire it may be put in his charge as he has the title bond and my receipts for the purchase money I have paid. I desire him to take the note given me by Lears and Edge of Lexington for $222, and the note given me by J. F. Miller for $285, both of which notes will be due in June next and pay off the portion of purchase money that will be going to Mrs. Lovitt Ann Jeter and to take two notes given me by the same persons for the like sums which will be due in June 1842 and pay off James Masterson on his portion of purchase money, and I desire him to have the deed made to my wife, Mary F. Masterson, to have and to hold during her natural life, and after her death, I give and bequeath it to my six daughters, to wit: Nancy Margaret, Sarah Thomas, Elizabeth Frances, Ann Patsey, and Joanna, and lastly, to have this my last will and testament faithfully executed.
I hereby nominate, constitute and appoint my two friends, Joseph F. Wilson and Edward B. Bartlett my executors, and desire them to quantify as such. In testimony whereof I have hereunto set my hand and affixed my seal this 20th day of February in the year of our Lord 1841. John C. (X) Masterson. Signed, sealed, and acknowledged in presence of H. County.
I, Wm. Smith, Clerk to the court for the county aforesaid do certify that
the foregoing will of John C. Masterson, deceased, was produced in open court
on the 8th of March 1841 and fully proven by the oaths of H. Thomas and J.
W. Collins subscribing witnesses thereto whereupon the said last will and
testament is ordered to be recorded which is accordingly done. Given under
my hand April 9, 1841. Wm. Smith, Clerk.
