In the name of God, Amen, I, Jacob New, of the County of Grant and State of Kentucky being sick and weak in body but of sound mind and disposing memory for which I thank God and calling to mind the uncertainty of life and the certainty of death and being desirous to dispose of all such worldly estate as it hath pleased God to bless me with, I give and bequeath the same in the following manner, that is to say, I give to my wife, mary New, the one third part of my land an perishable property during her natural life, after her death the perishable part to be equally divided between my after named heirs.

First, I give to my son, James New, my upper tract of land containing one hundred and eight acres to include the house and _____ where I now live and he is to take good care of his mother and have the benefit of her third during her natural life, then to be equally divided among my after named heirs by the said James New paying Henry New, his brother, fifty dollars for his part of the land. James is to keep the stock he now claims as his own and is not to come in with the rest of the heirs for any part of my property except the land.

Second, I give to my son, Abraham New, the two hundred acres of land which I bought off Joseph Points by his giving Henry New his brother fifty dollars for his part of the land.

Third, I give to my daughters, Susan and Mary New, one hundred and fifty dollars a piece for their services since they became of age over and above the rest of my heirs, also a bed and cow and calf a piece, or the value of them, then all my estate except the land to be equally divided between my after named heirs which is Elizabeth Morgan, Catharine Clark, Susan New, Mary New, Henry New and Abram New. Abram is to have a cow and bed as the others has; and lastly, I do hereby constitute my son, James New and son-in-law, Jeremiah Morgan executors of this my last will and testament, hereby revoking all other or former wills or testaments by me made heretofore.

In witness whereof I have hereunto set my hand and affixed my seal this 31st day of August 1839. Signed, sealed and published and delivered as and for my last will and testament of the above named Jacob New in the presence of, Robinson Nelson, Wm. H. Nelson.   Jacob (X) New.

State of Kentucky Grant County.
I, H. B. Smith, clerk to the county court for the aforesaid do certify that this the last will and testament of Jacob New, deceased, was produced to the court and proven by the oaths of Robinson Nelson and Wm. Nelson on the 9th day of September 1839 to be the act and deed of said Jacob New whereupon the said will was ordered to be recorded. Attest: H. B. Smith, Clerk, by Wm. Smith, Deputy Clerk.
