In
the name of God Amen! I, Joseph Odor of Grant County, Kentucky, being in
common good health and of sound mind and disposing memory and calling to
mind the uncertainty of human life, and being desirous to dispose of all
such worldly goods or estate as it hath pleased God to bless me with, I give
and bequeath the same in manner following, that is to
say:
First. Immediately after my decease I wish all my perishable property to be sold and all my just debts and funeral expenses to be paid out of the same.
Secondly. I give and bequeath one-third part of my real and personal estate to my beloved wife, Sarah Oder, during her natural life for her own use and benefit.
Thirdly. I give to my two sons, Thomas J. Oder and Jared R. Oder, all my land lying in Grant County, Kentucky and on the waters of Crooked Creek to be divided as follows making the Scaffol Lick Fork the line up Wm. Morgan's line then the remaining portion on the west side of said creek to Jared R. Odor.
Fourthly. I give and bequeath to my grandchildren Julian Porter, Jasper Newton Odor, Sarah Elizabeth Oder, Josephus Order, William Oder, Perlina Oder all the remaining portion of my personal estate bo be equally divided between them.
Fifthly and Lastly. I do hereby constitute and appoint my son Jared R. Odor executor of this my last will and testament hereby revoking all others made by me. In witness whereof I have hereunto set my hand and affixed my seal this 15th day of September 1857. Signed Joseph (X) Oder. Court December Term 1858.
I,
E. H. Smith, Clerk of the County Court for the County aforesaid do certify
that the foregoing will of Joseph Oder, deceased, was produced to court and
proven by the oaths of Isaac Ranny and W. H. Morgan, subscribing witnesses
thereto and ordered to be recorded whereupon the same and this certificate
are duly recorded in my office December 16, 1858. Signed E. H. Smith
