I,
James O'Hara, counsellor and attorney-at-law of Williamstown, Kentucky do
make this my last will and testament in manner and form
following:
1. I charge my real estate (except as herein disposed of) with the payment of my debts and empower my executor to sell and convey so much as may be necessary for that purpose upon such time and terms as he may think proper.
2. I give to my wife my residence in Williamstown, or wheresoever it may be for and during her life.
3. I also give to her my household and kitchen furniture, also all my books of every sort which she may distribute amongst our children as she think proper reserving to herself such as she chooses.
4. I give to my wife all my slaves and their increase, if any, there be to wit: Killy and her fur children and my young Negro woman Cordy or Cordelia to be enjoyed by her during her life.
5. I give to my son, Theodore O'Hara, three hundred acres of land of average with the residue of my land.
6. At the request of my son, James O'Hara Jr., I became his surety and one hundred acres of my land at O'Hara Crossroad were sold to pay the debt, and the land was not redeemed but was lost to me and for which I charge my said son, but intending to do justice to my children and to make them equal I give to my son, James, two hundred acres of land of average value with the rest of my land which added to the land sold by execution as set forth in Item #6 (this item will make three hundred acres of land given to my said son James.
7. I desire that my son Theodore be sent to some school or college as his mother shall direct during two sessions next before he shall have arrived at full age.
8. If my wife shall think proper to sell any or all of my slaves as she is at liberty to do so, but must invest the proceeds in other slaves for the use of my family or place the money at interest, she to have the use of the interest to aid her her support.
9. I wish my executor to remove the remains of my children buried in Owen COunty and Grant County and of my wife's sister, Catharine Hutchinson and of her two brothers, Robert L.. Hardy and James Hardy and to re-enter them and in such a place that my wife shall think proper.
10. If my wife shall wish to removed to Florence or elsewhere she is at liberty to sell all my property in Williamstown also my Tom Archers? land about 150 acres also my Stephen Welch land about 100 acres all of which she may apply to building or purchasing a new residence and till she shall thing proper to do so, I give to her the said two tracts of land to be by her used as she may think proper during her life.
11. After the death of my wife I wish my wife I wish my slaves to be sold and the proceeds to be divided the children of my son Charles to have one share should my out land be sold or divided the said children to have one share and in any division of my estate the said children are to share as their father if living would do.
12. I desire that my executors hereinafter named shall have a liberal allowance made to him for his trouble and expense for performing this last will and testament, and lastly I constitute and appoint my son, James O'Hara, now of Covington, Kentucky, my executor of this my last will and testament. The
foregoing last will and testament of James O'Hara, deceased, was produced
to court at the above term and after being proven by the oaths of William
Rankin and O. D. M McManma to be wholly, including the signature thereto,
in the handwriting of the said James O'Hara was ordered to be recorded whereupon
the same is duly recorded in my office this 16th of March 1861. Attest: E.
