In
the name of God Amen, I, Leland Pattie, of the County of Grant and State
of Kentucky, being of sound mind and memory and in considering the uncertainty
of this frail and transitory life, I do therefore make, ordain, publish and
declare this to be my last will and testament; that is to
say,
First, after all my lawful debts are paid and discharged, the residue of my estate real and personal, I give and bequeath first to my beloved wife, Judith F. Pattie, to hold for her exclusive use and benefit during her natural life, after which I bequeath the same to my son, Jo Lee Pattie or to hold the same during the minority of my son, Jo Lee Pattie, after which it shall be equally divided between them.
Secondly, that Frances G. Wilson shall remain with my wife, Judith F. Pattie, and have a support from the estate. Also, I hereby give to my wife, Judith F. Pattie, full power and authority to sell and convey full title any or all of my personal or real estate at private or public sale and invest the proceeds, or lease the same as she may deem best for the interest of my family.
And, I hereby nominate, constitute and appoint my said wife, Judith F. Pattie, executrix of this my last will and testament. Also that there shall be no security required by the court of the said executrix. In witness whereof I have hereunto subscribed my name and affixed my seat the 6th day of February in the year 1858. The above written instrument was subscribed by the said Leland Pattie in our presence and acknowledged by him to each of us, and he at the same time published and declared the above instrument so subscribed to be his last will and testament, and we at the testors request, and in his presence, have signed our names as witnesses hereto and written opposite our names our respective places of residence. Court March Term 1858.
The
foregoing will of Leland Pattie was at the term above stated was produced
in court and proven by the oaths of W. Points, Wm. S. Dickerson and R. A.
Dickerson, subscribing witnesses thereto, to be the last will and testament
of Leland Pattie, the same then was ordered to be recorded, which is duly
recorded in my office this 30th of March 1858. Attest: R. N. Carter,
Clerk.
