I, H. Woodyard, do make and publish this as my last will and testament. I desire that my executor who I will hereafter name be vested with full power and authority to sell all my real estate in Williamstown, consisting of two lots and one house, the house now occupied by me, the other lot on Paris Street and conveyed to to me by A. Gorman.

I desire my wife if she wants to sell any of the household and kitchen furniture (as I suppose she will) she is to select so much as she wants to keep and the balance to be sold and to sell all other property that I may have. I place all my fee bill accounts and notes and taxes due in 1848 and 1849 and all claims of every description to be placed in my executors hands. I nominate and appoint A. Kendall as my executor to carry this my last will into effect. I also desire that my son, Joseph, assist him in such things as he can attend to. I wish Joseph, my son, to go into the office and copy off all fee bills due me. I hereby authorize my executor to convey any real estate which I have spoken of in as good and ample manner as though I was present and done it myself, and to make any other conveyance to any person that may have a bond given by me requiring me to convey land. I wish my executor to sell my real estate on one and two years credit and the balance on such terms as he may as executor may think best. The cause of my selling the house I am now living in is that my wife is not willing to live here.

I desire that after my just debts are paid that my wife and three children be entitled to all my estate. I further desire if there be any suits brought for or against me that William L.? Rankin be employed to attend to them if it meets my executor's approbation. Also my books and papers be placed in his office so that my son, Joseph, may make out fee bills in his office and attend to all other business as I have been much afflicted for the last three years, and have not got my business posted up.  In testimony whereof I have hereunto set my hand this 18th day of March 1855. The foregoing will of H. Woodyard, deceased, was produced in open court at the term above stated and proven by the oaths of Seth Doud, John James and Wm. S. Woodyard, subscribing witnesses there to, thereupon the same together with this certificate has been duly admitted to record in my office. Given under my hand this 26th of April 1855.   B. M.
