Will of Buckminister McGuire
(note:  the following is only a portion of a lenghthy file.  I didn't include the testimonies of witnesses and the repeating of the will to each witness along with letters assigning the executrix.  I did include the petition for letters of testimony since it listed places of residence for parties involved.)


I, Buckminster MCGUIRE, of Beattyville, Lee County, Kentucky, being of sound and disposing memory, do make and publish this my last will and testament, hereby revoking all others.  Thsi is to say:  First:  I desire that all my just debts and funeral expenses be first paid out of my estate after my decease.

Second:  I give, devise and bequeath to my wife Kate. D. MCGUIRE, all my real and personal property, wherever situated, including all choses in action and all other property of every descripton owned by me at the time of my death, to be her's absolutely and to do with as she may desire, with full power to sell any or all of my property for her own use and benefit, and to make deeds and conveyances and to use all of the proceeds thereof as she may see proper.

Third:  It is my will and desire that my said wife Kate. K. MCGUIRE, be appointed excutrix of this my last will and testament, and I request that the County Court of Lee County permit her to be qualified as my executris without bond of any kind or without being sworn, and I further request that no inventory of my estate be made.

Fourth:  My said executrix, Kate D. MCGUIRE, is authorized and empowered to make sale and deeds of conveyances of all of my property as such executrix and as my sole heir and devisee, it being my intention to vest in her individually and as my executrix full and complete title to all of my propery everywhere, real, personal and mixed.

Witness my hand this 9 day of June 1921.

The undersigned, W. O. BRADLEY and A. H. BOWMAN, hereby certify that they were personally present and saw the testator, Buckminster MCGUIRE, sign the foregoing Will, and that we are witnesses to said will duly subscribed thereto as above.

Petition For Letters Testamentary
To The Honarable Thos. A. MCNICHOLAS County Judge:
The petition of Kate D. MCGUIRE respectfully shows:

1.  That she is the widow of Buckminster MCGUIRE, who died testate on or about the 21st day May, 1938, while he was a resident and citizen of HIghlands County, Florida, leaving an estate, the approximate value of which is more than $1,000.00.

2.  The residence of your petitioner is number 309 Magnolia Street, Sebring, Florida and the name age and residence of the surviving spouse and sole and only heir at law of decedent and the relationship to the decedent are as follows:

3.  The will of the deceased has been delivered to the county Judge of said county and filed by him.

Wherefore:  petitioner prays that said will be probated and admitted to record as the last will and testament of the said Buckminster MCGUIRE, deceased;  that letters testamentary be isssued to our petitoner, and that no inventory or bond be required of your petitioner as executrix of said will.

Petition For Appointment of Commissioners
To The Honarable T. A. MCNICHOLAS, County Judge:
Now comes Kate D. MCGUIRE and respectfully represents that a petition has been filed in the office of the county judge in and for Highlands County, Florida, for the probate of the last will and testament of Buckminster MCGUIRE, deceased;  that it is inconvenient for any of the witnesses to the said will to appear before the county judge as they are non-residents of Highlands County, and of the State of Florida;  that your petitioner is named in said will as executrix;  that the names of the witnesses to the said will are W. O. BRADLEY and A. H. BOWMAN;  that the residence of W. O. BRADLEY, one of the witnesses whose affidavit is to be taken, is Lee County, Kentucky;  and, the residence of A. H. BOWMAN, the other witness whose affidavit is to be taken, is Phoenix, Arizona.

Wherefore, petitioner prays for the appointment of Commissioners to take the respective affidavits of the said witnesses to the said will according to law.
