Will of Demia DAVIS

I, Demia DAVIS of Primrose, Lee County Kentucky being of full age and of sound mind and memory, do hereby make and publish and declare this to be my last will and testament.

1.  I direct that all my just debts and funeral expenses be paid out of my personal estate and if same is inadequate do so that my six children pay whatever balance that my [sic] be necessary and that same be pro rated as to which each shall pay, so as to leave my landed estate to be free and intact, and if same is complied with on a pro-ratea basis, then my land shall be disposed of as hereinafter provided.

2.  I give, bequeath and devise to my only son, John DAVIS, the following discribed tract of land and known as the "old home place" and beginning at or across the Country Road and opposite the Figgott Store where Primrose post offic was once located;  thence up the point to the top of hill, thence down the point to C. E. DAVIS line;  thence with said line to a poplar;  thence up to point with said line to Sarah Nancy POWELL's line;  thence with her line around the ridge;  thence with the ridge to a black oak;  thence to the top of the point to Eva DAVIS Heirs' line;  thence with said line out the ridge to a white oak to the gate near hauling road;  thence down the point to a sassafras tree;  thence with John DAVIS line to a spring;  thence from the spring to County Road;  thence with the County Road to place of beginning, Containing 75 acres more or less, and same t___ to pass and vest him absolutely and in fee simple.

3.  The remainder of my farm land of approximately five hundred (500) acres, I give, bequeath and devise to Nannie STEELE, Callie CHAMBERS, Lelah NAPIER, Alice LAIR and Edna PALMER which land is to be divided as nearly equal as possible as to quantity and value, and each of my five named daughters are to share alike in the said five hundred acres and the same shall pass and vest in them absolutely and fee simple when my debts and funeral expenses are paid after my demise.

4.  Should there be any personal property distributable after debts and funeral expenses are paid the same shall be distributed equally between my son and five duaghters.

I have executed and hereby set my hand at Beattyville, Kentucky all of my own free will and accord and without coercion or the influence of others and that same is my free and voluntary act, this (blank) day of April 1940

Signed by Demia DAVIS and by her acknowledged to be her last will and testament in our presence, sight and hearing, who at the request of said testator ahve hereunto subscribed  our names as witnesses in her presence and in the presence of each other at Beattyville, Kentucky, this (blank) day of April, 1940

I, Elizabeth MATTOCKS, clerk Lee Count Court do hereby certify that the foregoing Will of Demia DAVIS was on the 23d day of August 1943 filed in my office for probate and whereupon said will having been established by the Court to be said Last Will and testament of Demia DAVIS, deceased, same is hereby ordered to be recorded;  whereupon the same with the foregoing and this my certificate have been duly recorded in my said office in Will Book No. 1, page 464.
