Will of F. M. ASHLEY


Commonwealth of Kentucky
County of Lee

Know all men by these presents:

That I, F. M. ASHLEY of Beattyville, Lee County, Kentucky being of sound mind and memory and recognizing the uncertainty of life do make declare ordain and publish this my last will and Testament.

1.  I desire that immediately after my death all my just debts be paid.

2.  It is my will and I give and bequeath to my daughter Margaret JONES of Dayton, Ohio at my death the York tract of land lying and being in Lee County on the waters of the South Fork of the Kentucky River, consisting of 60 acres more or less and being on the tracts I bought from J. F. HARRIS.  I also give and bequeath to my said daughter Margaret JONES the Tennie Bailey tract of land consisting of 56 acres and lying and being on the South Fork of the Ky river in Lee County.  I also give and bequeath to my said daughter Margaret JONES the Drke Tract of land consisting of 26 acres lying on said South Fork of Ky river in Lee County and being the tract I bought from P. Y. DRAKE.

2.  I will and bequeath to my son, Harvey ASHLEY of Portsmouth Ohio the Robinson Hollow tract of land consisting of about 200 acres and lyind in Lee Co. Ky. and being one of the tracts which I bought from J. F. HARRIS.

3.  I will and bequeath to my former wife Ida OAKES of Beattyville, Ky. what is known as the river farm consisting of 26 acres on the South Fork of the Ky river in Lee Co and which I bought from BRANDENBURG and STIDHAM.  I also give and bequeath to my said former wife Ida OAKES the Tom Stapleton tract of land consisting of seven acres and which adjoins? said 26 acre tract.

4.  I will and bequeath to my wife Gladys ASHLEY the Davidson Farm of 46 acres which lies in Lee County, Ky on the South Fork of the Ky. river and which I bought from the heirs of Bob DAVIDSON, deceased.

5.  It is my will that after the payment of my burial expenses and all other just debts that all of my personal property be sold and the proceeds divided equally between my wife, Gladys ASHLEY and my children, Harvey ASHLEY and Margaret JONES.

6.  I hereby appoint and nominate S. A. THOMPSON of Beattyville, Ky. as the Executor of this my last will and testament.

In testimony of all of which witness my signature on this the 19 day of January 1938 at Beattyville, Lee County, Kentucky.

I, Elizabeth MATTOCKS, Clerk Lee Couty Court, do hereby certify that the foregoing will of F. M. ASHLEY, was on the this day lodged in my office for record.  Whereupon the same with the foregoing and this my certificate have been duly recorded in my said office in Will Book No. 1, Page 361.

Know All Men By These Presents, that I, Gladys ASHLEY, widow of F. M. ASHLEY, deceased, do hereby renounce the provisions of the will of my said husband, F. M. ASHLEY, who died a resident of and domicled in Lee County, Kentucky, on the 28th day of January, 1938, and which will was on the 14th day of February, 1938, admitted to Probate by the Lee Co. Court, and established as the last will and testament of said F. M. ASHLEY;  and I hereby relinquish the provisions of said will for my benifit,a nd elect to take my dower and distributable shar of my said husbands estate, as if no will had been made by him.

I, Elizabeth MATTOCKS, Clerk of the Lee County Court, do hereby certify that the foregoing instrument of writing was this day produced before me in my office by Gladys ASHLEY, and acknowledged by her to be her act and deed.

I, Elizabeth MATTOCKS, Clerk of the Lee County Court do hereby certify that the foregoing revocation of the will of F. M. ASHLEY, deceased, by his widow, Gladys ASHLEY was on the 26th day of February 1938 lodged in my office for record;  whereupon the same with the foregoing and this my certificate have been duly recorded in my said office in Will Book #1, Page 361.
