Will of  Henry C. DICKERSON

In the name of God Amen:  I, Henry C. DICKERSON of the County of Lee in the state of Kentucky, realizing the uncertainty of human life and being of sound and disposing memory do hereby publish this my last will and testament:

I would first state that I am the owener of the following described real estate, the following personal property and the the following dets are due and owing me:
I own one house and lot in the town of Proctor, Kentucky where W. C. SCHOLL now lives and one half of a one hundred and twenty two acre tract of land lying in the Duck fork of Sturgeon waters of the Kentucky river and deeded to myself and ?Morean BROWN by Asa and Henry SMITH and their wives; said deed is recorded in the Owsley County Court Clerks Office.  I am the owener of one Spring Wagon, one set of double harness, two horses, one mule, one cow and lot of bed clothing.  And there are the following debts:  One note on W. C. SCHOLL, L. C. F. DICKERSON and Hiram HOGG for seventy Dollars being for the rent of my house and lot where he now resides and due the 8th day of November 1879 and a ballance of unpaid purchase money from L. C. F. DICKERSON of one hundred and seventy Dollars upon the house and lot where Albert CHILSON now lives, known as the BLOUNT property in the town of Proctor.

1st I will and direct that the house and lot where W. C. SCHOLL now lives in the town of Proctor, KY. be rented out either privately or publicly as my Executor, whom I shall hereafter nominate may see proper, until my youngest son William B. shall attain the age of 21 years at which time if he and my eldest son Albert Eugene can and will agree as to its control and management, or its rents or proceeds of sale, should they desire to sell said property then my Executor shall give them full and entire possession and control of said property.  But should they disagree as to its management and control or should either or both of my sons die before the youngest attains the age of 21 years leaving lawful issue of their bodies then my Executor will sell said house and lot at the highest bidder in a credit of Twelve months taking bond from the purchaser payuable to himself as Executor with approved security and when the sale money is collected to divide the same equally between my two sons or the lawful issue of their bodies.

I will and direct that my land on the Duck fork of Sturgeon as before named be held in trust by my Executor for the benefit of my two sons until the youngest attains the age of 21 years at which time my Executor shall give them full and entire control of the same unless one or both die leaving issue of their bodies before that time in which event he is directed to sell the same as directed in the first clause  h_____ of, dividing the proceeds equally between the surviving one and the lawful issue of one or both of my said sons.

I will and direct that my executor sell either privately or publicly all the personal property as beofre stated except my bed clothing which I entrust to Mrs. John M. DAVIDSON for the use and benefit of my two sons and I also will and direct that my Executor collect all my debts due and which may become due hereafter which I have before named and he will divide all monies and rents of my property equally between my two sons or their lawful issue at the time herein after mentioned.  But I first desire that all my just debts be paid after which the monies and rents received are to be equally divided as before directed and are to be loousd? at lawful in trust as also any monies received from the sale of any of my real estate should it become necessary for my Executor to sell, until my youngest sons attains the age of 21 years.

I further will and direct that if either of my sons die before the youngest attains his majority leaving issue of their bodies then my Executor shall divide all my real estate or monies received or due from any source whatever equally between the surviver or their lawful issue,  But should both die without issue before the youngest attains the age of 21 years, I will and direct that the sum of two hundred Dollars be given to Saint Paul's Protestant Episcopal Church in Proctor, KY. of which I am a member and remainder of my Estate divided equally between my brother L. C. DICKERSON and my sister Martha Jane CROSS and I do hereby nominate and appoint John M. DAVIDSON my Executor who will carry into Effect the provisions of this my last Will and testament.

Given under my hand and seal in the presence of H. L. WHEELER and M. F. REED as attesting witnesses, this the 2nd day of December 1878

An Instrument of writing purporting to be the last will and Testament of Henry C. DICKERSON, deceased, was this day produced in Court and proved by the oaths of H. L. WHEELER and M. F. REED, the subscribing witnesses thereto:  It is therefore ordered that the said Instrument of writing be and the same is established as the Last Will and testament of H. C. DICKERSON dec'd and as such duly admitted to record.

I, W. P. HILL, Clerk of the County and State aforesaid do certifiy that the foregoing Will of H. C. DICKERSON, together with the order of Court establishing same, have this day been duly admitted to record.
