Will of Helen Bays


Know All men by These Presents:

That I Helen BAYS of Beattyville Lee Co being in failing health but sound in mind and memory do publish, ordain, and declare this to be my last Will and Testament hereby revoking any and all other wills heretofore made by me.

1.  That all my just debts and funeral expenses be paid soon as possible after my death.

2.  That I will and bequeath to my son Warren BURNETT of Luann Arkansas my real estate consisting of the house and lot in Beattyville, Ky where I now live.

3.  All the balance of my person property existing at my death and after the payment of my just debts I will and bequeath equally to the following persons, share and share alike to my son Warren BURNETT of Louann Arkansas, 1/3, to my grand daughter Ola TACKETT of Lexington Ky 1/3, to my niece Mary PHIPPS of Beattyville Kentucky 1/3 pr___ that the 1/3 interest devised to Mary PHIPPS to be hers on the condition that she stays with me until my death, and _____ her failure to so stay and care for me any said personal property shall be divided equally between my son Warren BURNETT and my grand daughter Ola TACKETT.  PRovided that I will and bequeath to my niece the said Mary PHIPPS the large steel strunk and all remaing therein at my death, same to be hers before the balance of my personal property is divided and to be heres independent of said division.  Provided she stays with and cares for me as above set out.  if she fails to so stay and care for me said trunk to go in the division between my said son and grand daughter.

4.  I hereby nominate W. C. BRANDENBURG of Beattyville Ky as the executor of this my last Will and Testament

We. D. C. HOWELL and Arch ISAACS do hereby certify that the foregoing will of Helen BAYS was signed by her and declared by her to be her last will and testament in our presence and that we both witnessed same in her presence and in the presence of each other on this the 5th day of December 1931

I, Thomas C. PRYSE, Clerk of the Lee County Court certify that the foregoing will of Helen BAYS deceased was on the 14th day of December 1931 filed in my office for record and the same having been proven in open Court as the law directs, and having lain over thirty days for exceptions and no exceptions having been taken same was ordered to record on the 11th day of January 1932;  whereupon the same with the foregoing and this my certificate have been duly recorded in my said office in Will Book No. 1, page 286.
