Will of Hannah McGuire



 

I, Hannah MCGUIRE first giving to God the glory for all his mercies and blessings, given unto me through a period of a long life, do hereby ______ this as my last will and testament and being sound mind and disposing memory. 

I will first that at my death I be decently but not expensively interred in the old family burying ground near the old residence of James MCGUIRE deceased on the Middle fork in Lee County and that my daughter Nancy MATTOCKS pay the expenses of my burial for which and other kind and loving ____ to me during many years of helpless old age hereinafter provide.

2nd I am seized and possessed of a small tract of coal land on the South fork of the Kentucky river in Lee County Ky and described and embraced _____ deed from David Goosey and wife to me on record in the County Clerk office in Lee County this tract of Land with all the reg___ and priveliges pertaining thereto I give and bequeath to my daughter Nancy MATTOCKS  in consideration of love and affection and of her constant ___ watchfulness and support of me during the ___ past years of my entire helplessness to care for and support myself but this coal land and privileges is bequeathed to my said daughter Nancy on the conditions that it is to be forever free from all debts and liabilities for which said Nancy is now liable and responsible or which she may hereafter contract.  She is authorized to dispose of said coal land as she pleases and when so disposed of I will and direct that she pay from the proceeds of the sale of same the sum of Twenty five dollars in cash or other thing of value to each of my following named children.  Matilda HADDIX, Albert HADDIX, Cecily WILSON and the widow and children and heirs at law of Nathan HADDIX deceased, these three named children to be paid $25.00 each adn the widow and heirs of Nathan HADDIX deceased to be paid a like amount and the proceeds from the sale of said land shall be free and exempt from any and all debts and liabilities now existing against any of said children and devisees on which may hereafter be contracted by them.  I further will and devise that my daughter Nancy MATTOCKS shall have all and every description of personal property of which I die possessed.

I also will and desire that after my death at such time and place as is most convenient first giving notice thereof to all or as many of my children and Grandchildren as possible of the time and place that my funeral be preached by Revs W. H. Childers and John Thomas.

In witness whereof I have hereunto affixed my seal and signature in the presence of Thomas Pryse and J. M. Beatty attesting and subscribing witnesses hereto on this the 24th day of June in the year of our Lord 1887.

I C. B. Hill, Clerk of the Lee County Court hereby certify that the foregoing instrument of writing was produced in the Lee County Court on the 23rd day of April 1888 and filed and proved by the oaths of James M. BEATTY and Thomas PRYSE the two subscribing witnesses thereto and that said instrument was on the 29th day of January 1889, allowed and established by the said court as the last will and testament of Hannah MCGUIRE deceased, and as such ordered to be recorded ;  whereupon the same and this certificate have been this day duly recorded in my office as directed by the order of probate.  Given under my hand this 19th day of February 1889
