Will of John M. Cole


Know All Men By These Presents:

That I John M. COLE of Congleton Lee County Kentucky being of sound mind and memory do make and declare this my last Will and testament.

1.  I have heretofore deeded my home farm among my children leaving out the tract of land allotted to me out of the Timothy Johnson tract in Lee County in the partition case now pending in the Lee Circuit Court, styled Susan COLE vs Clayton CORNETT etc.  This said tract I will and bequeath to my Granddaughter Agnes SEALE PURSALL that is the surface only.  All the oil and mineral rights belonging to me in on and uncer said Timothy Johnson tract I will and bequeath to my son Shelt? COLE.

2.  I have an Insurance benefit of $250.00 in the J.O.U.A.M. lodge located at Beattyville.  I desire my funeral expenses to be paid out of the said benefit and out of the balance remaining out of same after my funeral expenses have been paid I will and bequeath to my Granddaughter Agnes SEAL the sum of #25.00, the balance remaining thereafter to be divided equally between Ruth HOBBS my granddaughter 1/3 Flora COLE my daughter and Flora COLE 1/3 as Trust for the usse and benefit of Norman COLE my son (1/3)

3.  I request that my Granddaughter Ruth HOBBS be given a home with my children at the home place as long as she remains single and wants to stay there and I also request my children that my sister Lizzie COLE be given a home with them as long as she wants to stay there.

In testimony of which I declare this my last will and Testament done at Congleton Lee County Ky. on the 16 day of February 1938.

We the undersigned do certify that the foregoing will and testament of John M. COLE was on the 16 day of February 1938, signed and acknowledged as such by the said John M. COLE in the presence of both of us and we further Certify that we each signed same as witnesses in his presence and in the presence of each other.

I, Elizabeth MATTOCKS, Clerk Lee County Court do hereby certify that the foregoing Will of John M. COLE, deceased, was on the 6th day of September, 1940, produced and filed in open Court whereupon same G. W. MATTOCKS and Lizzie COLE, on the 9th day of September, at a Regular Term of the Lee County Court, and same having been proven by testimonies of said two subscribing witnesses thereto, same was established to be last Will and testament of John M. COLE, deceased, whereupon the same with the foregoing and this my certificate have been duly recorded in my said office in Will Book No. 1 Page 427.
Given under my hand this 9th day of September, 1941
