Will of Presley Thomas


 
 
I, Presley THOMAS, of Lee County, Kentucky being of sound mind and memory do make, publish and declare this to be my last will and testament, hereby revoking all wills by me heretofore made.

I hereby will and devise to my neice Etta POWERS of Welty, Oklahoma, all of my right title and interest to the oil and gas in and under a certain tract of land located in Lee County, Kentucky, and fully described in a deed from Presley THOMAS and J. K. ROBERTS and wife to R. L. TURNER, dated December 12, 1903, and recorded in Deed Book NO. 11, page 414, Lee County Court Clerk's office, for and during her natural life;  and at her death I will and devise said interest in oil and gas to Eugene POWERS and Vivian POWERS (children of the said Etta POWERS), and Woodrow SMITH, my nephew, and Ruby HOGAN (daughter of James HOGAN by his first wife), these four named persons to take said interest jointly.

In testimony whereof, I appear to and subscribe my name in the presence of Hubert BLAKEY and E. B. BEATTY, who subscribed their names as witnesses to same at my request and in the presence of each other.  This March 14, 1922

We the undersigned, Hubert BLAKEY and E. B. BEATTY, both of Beattyville, Lee County, Kentucky, state that the above named Presley THOMAS signed the above writing purportng to be his last will and testament in our presence and that we each signed our names in his presence as witness es at his request and in his presence and in the presence of each other.

I, S. M. ESTES, clerk of the Lee County Court, do hereby certify that the above and foregoing will and testament of Presley THOMAS, deceased, was filed in my said office on the 12th day of February, 1929 at a regular term of the Lee County Court, and the same having been properly proven by the Court in open Court as the Law directs, same is ordered to lay over thirty (30) days for exceptions and no exceptions having been taken, the same is now ordered to be recorded at a regular term of the Lee County Court held on the 8th day of April, 1929.

Wherefore the same and this my certificate have been duly recorded in my said office in Will Book NO. 1, page 246.
