Pendleton County Deed Book K – Pages 484-485:

 

This Indenture made this 10th Day of July A D 1853 between Theophilus Briggs of the County of Pendleton State of Kentucky of the one part and Sebastian Emminger of the City of Cincinnati Hamilton County State of Ohio of the other part witnesseth that the said Theophilus Briggs for an in consideration of the sum of Three Hundred and Eighty Seven Dollars in hand paid the receipt whereof is hereby acknowledged hath granted bargained and sold and by These presents doth grant bargain and sell unto the said Sebastian Emminger his heirs and assigns all that tract or parcel of land situate and being in the County of Pendleton aforesaid part of an original survey pattented [sic] in the name of John Richard and Simpson Hulley on the waters of Stepstone creek a branch of the Ohio River and Bounded as follows to wit Beginning at a Beech Stump an ash and Small Black Walnut in the forks of Bear run corner to land of John Gaskins thence with his line N 15 [degrees] E 40 poles to his corner, two Hickories and red oak.  Thence N 75 W 22 pls to two small ash trees and white oak in said Grahams line Thence N 50 E 91 poles to two white oaks.  Thence S 4 [degrees] W 129 poles crossing Bear run to a stone on the bank Halls corner, in said Grahams line Thence with his line N 68 W 61 pls to the Beginning containing thirty acres & 24/100 being the tract of land upon which the said Briggs now resides, and the tract of land conveyed by W.L. Thompson to said Briggs by Deed of Record in the clerks office of the Pendleton County Court together with all and singular the appurtenances thereunto belonging or in any wise appertaining to have and to hold the said hereby conveys with the appurtenances unto the said Sebastian Emminger his heirs and assigns forever and the said Theophilus Briggs for himself his heirs executors and administrators the aforesaid Tract of land and appurtenances unto the said Sebastian Emminger his heirs or assigns against the claim or claims of all and every person or persons whatever doth and will forever warrant and defend by these present.

            In witness whereof the said Theophilus Briggs together with Nancy his wife who hereby relinquishes her right of dower in and to the land conveyed by this deed have hereunto set their hands and seals the day and date above written.

Pendleton County Deed Book Q – Page 104:

 

Know all men that I B.A. Gaskins of the County of Pendleton and State of Kentucky for and in consideration of the sum of Three hundred dollars to me paid by Sebastian Eminger [sic] of the County and State aforesaid the receipt whereupon hereby acknowledged does hereby Bargain Sell and Convey to the said Sebastian Eminger [sic] his heirs and assigns forever the following Real Estate court: Lying and being in the County of Pendleton and State of Kentucky and on the waters of Stepstone Creek and bounded as follows.  Beginning at a Stone near an Ash in the edge of a [   ] Thence N 14 [degrees] E 39 Poles to a hickory: Thence N 76 W 61 ½  poles to an Ash and white oak:  Thence S 14 [degrees] W 40 Poles to a Stone: Thence S 76 E 60 poles to the beginning containing fifteen Acres be the same more or less together with all the privileges and appurtenances to the Same belonging To have and to hold the Same to the Said Sebastian Eminger [sic] his Heirs and Assigns forever The Grantor his Heirs Executors and Administrators Hereby Covenanting with the Grantee his heirs and Assigns that the Title so conveyed is clear free and unencumbered and that he will Warrant and Defend the Same against all claims whatsoever.

In Witness Whereof the Said B A Gaskins together with Louisa Gaskins his wife who hereby relinquishes all of her tight to dower in the land hereby conveyed have hereunto set their hand the 20th day of August in the year 1864.

This Indenture made and entered into this 18th day of Feby 1888 between L L Hobbs of Campbell County, Kentucky of the first part and Sebastian Emminger of Pendleton County Kentucky of the second part.  Witnesseth said party of the first part in consideration of one hundred Dollars to him paid by the party of the second part, in hand paid receipt whereof is hereby acknowledged hereby bargain, sell and convey unto said party of the second part, his heirs and assigns the following said [     ] in Pendleton County Kentucky.  [    ] and on the waters of Stepstone Creek bounded as follows: Beginning at a stone in Heizels line at side of county road [                             ]

Thence N 66 ½ W 130 poles to a stone in the original line of said Hobbs and Emminger.  Thence [  ] 26 ½  W [    ] poles to a stone.  Thence S 66 Ύ E 60 ½ poles to a [     ].  Thence S 64 [degrees] E 33 ½ poles to the beginning containing four (4) acres be the same more or less to have and to hold said premises together with the privileges and appurtenances to the same belonging unto said party of the second part, his heirs and assigns forever with [       ] warranty.  In Witness Whereof the said L L Hobbs together with Elizabeth his wife who hereby relinquishes her right to dower and each of whom hereby waive all right to homestead exemption in the premises hereby conveyed have hereunto set their hands the day said date first above written.

Pendleton County Deed Book 57 – Pages 632-633:  

 

This Indenture made and entered into this 5 day of Nov. 1906 between Sebastian Emminger Sr of Pendleton County, Kentucky, of the first part, and Edward Emminger and John Emminger of Pendleton County, Kentucky, of the second part.  Witnesseth, that said party of the first part, in consideration of One hundred Seventy five dollars in hand paid the receipt whereof is hereby acknowledge, does hereby bargain, sell and convey unto said party of the second part, their heirs and assigns the following Real Estate in Pendleton County, Kentucky: to wit, Beginning at a beech stump, ash and small black walnut in forks of Bear Run corner to land of John Gaskin.  Thence with his line N 15 E 40 poles to his corner two (hickories and red oak).  Thence N 75 W 22 poles to two small ash trees, and white oak in Gaskins line, thence N 4 W 129 poles crossing Bear Run to a stone on the bank, Halls corner in said Gaskins line.  Thence with his line N 68 W 61 poles to the beginning containing Thirty acres and 24/100.  30 acres 24/100.

 

2nd.  Adjoining above survey and bounded as follows.  Beginning at a stone near an ash in the edge of a branch.  Thence N 14 E 39 poles to a hickory.  Thence N 76 W 61 ½ poles to an ash and white oak.  Thence S 14 W 40 poles to a stone.  Thence S 76 E 60 poles to the beginning containing 15 acres more or less.

 

3rd.  Also adjoining and bounded as follows.  Beginning at a stone in Heisle line at side of County road.  Thence S 24 Ύ W 4 38/100 poles to a stone in the middle of the road.  Thence N 66 ½ W 15[] poles to a stone in the original line of said Hobbs and Emminger.  Thence with that line S 72 ½ E 55 poles to a stone.  Thence S 26 ½ W 1 1/5 poles to a stone.  Thence S 66 Ύ E 60 ½ poles to a stone.  Thence S 64 [degrees] E 33 ½ poles to the beginning containing four acres more or less.  The first of these conveyances is recorded in Deed Book K Page 484.

The 2nd recorded on Page 104, Deed Book Q.  The 3rd recorded on page 148 Deed Book 39.  All at Falmouth Ky Pendleton Co records.  To have and to hold said premises, together with the privileges and appurtenances to the same belonging unto said party of the second part, their heirs and assigns forever, including all right to dower and homestead exemption with covenant of general warranty.

            In Witness Whereof, the said Sebastian Emminger has hereunto set his hands.

Houston, a Notary Public for the County aforesaid, do certify that this Deed from Sebastian Emminger Sr to Edward and John Emminger was on the 5th day of Nov. 1906 produced to me in said County by the grantor Sebastian Emminger Sr and acknowledged by him to be his act and deed.  My commission expires 6th day of March, 1910.

exemptance, with covenant of general warranty.  This deed is made by the said E. F. Gaskins as Administrator De Bonis non with the will annexed of the estate of L. L. Hobbs decd and by virtue of the last will and testament of the said L.L. Hobbs decd which is recorded in Will Book D, pages 273&4 at Alexandria Campbell County Kentucky and the tract of land conveyed by this deed is sold and conveyed for the purpose of paying the debts against the estate of the said L.L. Hobbs, decd, as directed by said will and the grantors Mary A. Earle and William L. Hobbs being the children and only heirs at law of the said L. L. Hobbs, decd, join in this conveyance for the purpose of conveying any interest they may in said lands as heirs at law of the said L.L. Hobbs, decd.  In Witness Whereof the said E.F. This Indenture made and entered into this 7th day of January 1909 between Sebastian Emminger an unmarried man of Carntown Pendleton County, Kentucky grantor; and Joseph Emminger of Pendleton County Ky grantee.  Witnesseth, that said grantors, in consideration of Six hundred Dollars to him paid and to be paid by said grantee, as follows.  Viz:  Four hundred Dollars in hand paid, the receipt whereof is hereby acknowledged.  One hundred Dollars to be paid on the 7th day of January 1910.  One Hundred Dollars on the 7th day of January 1911.  Said deferred payments evidenced by two promissory notes of this date, due as aforesaid, and bearing interest from date, and to secure the payment of which a lien is hereby retained, does hereby bargain sell and convey unto said grantee, his heirs and assigns, the following Real Estate in Pendleton County, Kentucky:  towit:  My one-half interest in the following described real estate.

This Indenture made and entered into this 30 day of June 1908 between Theo Carnes and Alice E. Carnes his wife of Butler R.F.D. #1 Pendleton County Kentucky, grantors, and Edward Emminger of Pendleton County, Kentucky, grantee; Witnesseth, that said grantors in consideration of Thirteen Hundred Dollars to them paid and to be paid by said grantee, as follows. Viz:  Eight Hundred Dollars to them paid.  The receipt whereof is hereby acknowledged.  Two Hundred and fifty dollars to be paid on the 30 day of June 1910.  Two Hundred and fifty dollars ton the 30 day of June 1912.  Said deferred payments evidenced by grantors two promissory notes of this date due as aforesaid and bearing interest from date, and to secure the payment of which a lien is hereby retained, does hereby bargain sell and convey unto said grantee, his heirs and assigns, the following Real Estate in Pendleton County, Kentucky:

 

Beginning at a stone corner to lands of L.L. Know all men by these presents: That A.M. McClanahan and Emma McClanahan, his wife, of Pendleton County, Kentucky, for an in consideration of Eighteen hundred dollars cash in hand to them paid by William Emminger the receipt whereof is hereby acknowledged, do hereby bargain, sell and convey to the said William Emminger, his heirs and assigns forever, the following described Real Estate, to wit: Situate lying and being in Pendleton County Kentucky on the turnpike leading from Carntown to Peach Grove bounded and described as follows: Beginning at a white oak tree corner to Sebastian Emminger; thence North 13 West 57 poles to a Black ash, Elm and Buckeye, corner to Bradbury, now Tony Steiner; Thence South 50 West 116 poles to a Hickory, Gum and White oak in J.W. Hobbs corner; thence South 40 East 105 poles to a small ash tree and pile of rock; thence South 50 West 3 poles to three Sums corner to J.W. Hobbs heirs and Edward Emminger; thence South 37 East 10 poles to three White oaks corner to L.L. Hobbs, now Joseph Emminger; thence North 14 East 112 poles to the beginning containing 49 acres 2 roads and 37 poles more or less.

 

Being the same land conveyed to grantor A.M. McClanahan by Richard Bell 7 wife by deed dated July 2, 1909 and recorded in Deed book 60 page 562 Pendleton Court records together with all the privileges and appurtenances to

the same belonging.  To have and to hold the same to the said William Emminger his heirs and assigns forever, the Grantors, their heirs, executors and administrators, hereby covenanting with the grantee his heirs and assigns, that the Title so conveyed is clear, free and unencumbered, and that they will warrant and defend the same against all legal claim whatsoever.

 

In Witness Whereof the said grantors A.M. McClanahan & Emma McClanahan, his wife, who include, release, and transfer to said grantee all homestead exemption, dower and other right to said property, hereunto set their hands this 20 day of Febry in the yr, 1918.
