John Horner, Russell Horner, Elijah Horner and John Lomax ,are on the 1816 tax list, of Lawrence Co. Missouri Territory. All, except Elijah Horner are back in Perry Co. TN., in 1820 census. Elijah's death has always been a mystery, in Horner research.

1821-Missouri officials meet in an emergency session on June 4th to draft a response nullifying the clause that would "prevent free Negroes and mulattos from coming to and settling in this state, under any pretext whatsoever." Missouri will not be allowed to enter the Union with that clause in the constitution. So they change it, and President James Monroe proclaims Missouri a state on August 10th. Maine is allowed to enter the Union as a free state and Missouri is a slave state. An 1820 census shows 66,586 persons, including 10,222 slaves. Missouri legislators meet from November 1821 to January 1822. They create the great state seal during this session. The capital of Arkansas Territory was moved to Little Rock in 1821.

Lincoln lost the election of 1832. His first run for office. His campaign slogan -- I am in favor of a National Bank, I am in favor of the Internal improvement system, and a high protective tariff. These are my sentiments and political principles. The Whig party ran, for some years, mostly in strong second place to the Democrats. The Whig Party, in the United States, was for most of its history concerned with promoting internal improvements, such as roads, canals, railroads, deepening of rivers, etc. Abraham Lincoln was a Whig for most of this period. The industrial north wanted the "American System" program of fostering economic development through transportation subsidies and through protective tariffs on imports to aid American manufacturers. They wanted to build their infrastructure through taxing the southern plantations. Many Southerners believed these policies promoted Northern growth at their expense. Immigrants coming into Arkansas, came mostly from the states of Tennessee, Kentucky, Virginia, North Carolina and Georgia. They came by land, or partly by land and partly by water. Many of them came all the way in ox drawn wagons. Some of them floated in flat boats down the Tennessee, Ohio, and Mississippi rivers to Ste. Genevieve and New Madrid and then by land the rest of the way; but some of them continued down the Mississippi river to Chickasaw Bluff (Memphis) and Helena, from which they might move westward and northward. Sometimes they went on to the mouth of white River and up that river. Soon after 1836 a road was opened from Izard county eastward through Lawrence County, (then including Sharp) to Greene county, This road went by the new towns of Smithville and Powhatan, where there was a fine ferry across Black River. In the late 1830's, the old north-south trail between Pocahontas and Jacksonport along the low ridge east of the floodplain of Black River was converted into a public road. It was the first north-south road opened between Black and Cache Rivers. It was an easy road to travel and very important until after the Civil war. It went by the steamboat landing places at Elgin, Clover Bend, Lauratown, and near Powhatan, It intersected the Izard county-Greene county road at the settlement then called Cross Roads about a mile south of the present town of Portia. His brother John and his sisters were on the Missouri side of the line. It is regarded by historians as the first bloodshed of the American Civil War. the Union army entered Baltimore, occupied the city and declared martial law, to prevent all further incidents. On April 12, one week prior to the riot, the battle of Fort Sumter started, signaling the beginning of the American Civil War. At the time, the slave states of Virginia, North Carolina, Tennessee, and Arkansas had not yet seceded from the U.S.. In addition, it was not yet known whether four other slave states, ( Delaware, Maryland, Missouri, and Kentucky) (later known as " border states"), would remain in the Union. When Fort Sumter fell on April 13 without a single man lost, the Virginia legislature took up a measure on secession. Arkansas entered the Union on June 15, 1836, as the 25th state. Farming was the chief source of income, but a meager source for many, particularly in the uplands. With the rich Plantations to the south and the Ozark Mountains to the west. There is a stream in the western district of Lawrence County called Flat Creek. It has its beginning at various springs just east of Smithville and Bows into Black River, about three miles south of Powhatan. Early settlers began to come to this valley about 1815 and during the period 1835-1860 this valley was filled with settlers. They belonged to good families from Tennessee, Kentucky, and Georgia. They acquired land and made permanent settlements. With the Mississippi River close by it was a region of great commerce. The military road, was opened about 1811, running north and south. A road which had been run between Powhatan and Smithville While early settlers were attaching themselves close to the road that led from Powhatan to Smithville, facts prove that evidently the log church-school building, which was later called Old Bethel, was erected in the early 1820's and given the name New Hope. In 1838, the Arkansas Gazette ran a story that included this statement about the prosperity of the new town: "The new town of Pocahontas, county seat of Randolph County, is said to have become, within 18 months of its existence, one of the most flourishing places within the state. Lots in the town had increased in value from 100 to 500 percent. The farm land in the county, which had sold for $1.25 per acre, was now much in demand at $20." In fact, all this good fortune had led some to proclaim Pocahontas as the "metropolis of the West." . In 1857 James Cude bought over 200 acres in Randolph, Co. AR. Which was about 5 times the normal farm of the time, which was about 40 acres. I can find no record of any slaves in his name. Between 1840 and 1850 they had 4 more children, that we have a record of. This has Cecelia Cude as born in 1842 in Missouri. John was in the area prior to this date. The Cude cemetery is located in Clay Township, Dunklin Co. MO. on an old Indian mound, near Hornersville. In 1861, Union Gen. John C. Fremont instituted martial law in Missouri and declared slaves there to be free. (However, Fremont's order was countermanded days later by President Lincoln). One of the reasons Lincoln and the Republican Party establishment gave for their opposition to slavery was, as he stated in his October 16, 1854, speech, that “the whole nation is interested that the best use shall be made of these [new] territories. We want them for the homes of free white people. This they cannot be, to any considerable extent, if slavery shall be planted with them.” The north had a surplus of unemployed emigrant labor from Europe was trying to move it west. Labor market protectionism was a basis for Lincoln’s opposition to the extension of slavery. A key strategy of the Republican Party was to buy votes from white laborers and move them in to the territories. Indians needed to be removed, to achieve this goal. In this speech Lincoln inferred the superiority of whites based on their discovery of gold in territory on which Indians and Mexicans lived for generations; he rhetorically asked “why did Yankees almost instantly discover gold in California, which had been trodden upon and overlooked by Indians and Mexican greasers for centuries?” (103). Lincoln also explained that phonetic writing was what separated whites from “savages,” and from that talent had derived the fruits of civilization- government, culture, etc., Lincoln and the North entered the war to preserve the Union rather than to free the slaves, but within a relatively short time emancipation became an accepted war aim. Why did the South want secession. if it was not about slavery? Neither Congress nor the president knew exactly what constitutional powers they had in this area; according to the Dred Scott decision, they had none. Lincoln had been reluctant to come to this position. A believer in white supremacy, he initially viewed the war only in terms of preserving the Union. As pressure for abolition mounted in Congress and the country, however, Lincoln became more sympathetic to the idea. Lincoln believed that the Constitution gave the Union whatever powers it needed to preserve itself, and that he, as commander-in-chief, had the authority to use those powers.

In 1874 James Cude’s property is being sold for back taxes. What happened to them?--There is no record of James in the 1880 census, but on April, 24, 1874 Randolph Co. Delinquent tax sale we have --estate -James Cude, Three parcels of land being sold for back taxes. The Plantations were on the Coastal Plain in Arkansas, which extends across the eastern and southern parts of the state in two sections. The easternmost section is composed of the fertile Mississippi Alluvial Plain. This is often called the Delta, and until it was cleared for agriculture it was an area of swamps, dense forest, and tangled undergrowth. Its flat expanse is broken only by a narrow strip of hills, called Crowley’s Ridge. Abundance of water is a distinctive feature of Arkansas. The entire state drains southeastward to the Mississippi River, which forms the eastern boundary of Arkansas. There the Mississippi flows and winds its way across a wide floodplain. John W Hufstedler lived between James Cude and John Horner Cude, the son of Horner Cude. Temperance Lomax and her husband Horner Cude's three sons, John Horner Cude., William H. and Horner Lomax., were volunteers and gallant soldiers in the Confederate Army. They participated in many battles - Chicamauga, Atlanta, Franklin, Nashville, etc. The first named died in KY., the second in GA., and the third was brutally murdered, not in battle, by Union soldiers, when he returned after the war. Andrew C. married three times and had a large family of children.

One of the many ghost towns in Arkansas is Jackson. The site of the town is about two miles north of Imboden on an old military road leading from Missouri to Smithville, to Polks Bayou (now Batesville), then to Little Rock. Within the boundary of the town, a never failing spring of exceptional water ran from the hillside. Here the pioneers paused to rest themselves and theirteams from the hard journey through the wilderness.

Here are some of the early land owners in the town of Old Jackson, and the year in which they owned it: 1866 -1.1. Bowers and Samuel Henderson; 1872- John M. Songer; 1876- Jesse R. Pratt; 1876- James W. Brady; 1881 -S.N. Pratt; 1885 -Charles Ward and Joseph N. Williams; 1889 -Nicholas Summers; 1891- E1bertJ. Cude; 1894-Elbert J S Cude was the son of James and Temperance Cude " Imboden is in the foothills of the Ozark Mountains. The beautiful Spring River, flowing near the north boundary of town, is swift, clear and cool. The fertile valleys and Lawrence County high hills make it a place beautiful to look upon." Randolph Co. was on the north side of Spring River. From 1819 until 1835, it was a part of Lawrence County, Arkansas Territory. In 1835, Randolph officially came into existence as a separate county in the Arkansas Territory. Arkansas was admitted to statehood in 1836.

On April 7,1887, a petition for incorporation was filed with Clay Sloan, the County Clerk of Lawrence County.
