Thomas BOTTS was the second son of Joshua and his second wife. Thomas was born 14 Aug 1789, in Wilkes County, NC, as were his brothers John and Seth. In 1811 he married he married Martha WILSON, a sister of the first wife of his brother Seth. Martha died 19 Sep 1877, and is buried in Botts Cemetery.
Thomas grew up in Clairborne County, TN. He and his brother Seth, both served in the War of 1812. With his father and at least one brother Seth, he came to Howard County, Missouri, in 1816. In Howard County he located in Prairie Township and the creek running through that settlement received its name in memory of him as the first settler of that community. For more than a year his only neighbors were Indians.
In the Court House in Howard County is a record of Thomas and Martha BOTTS buying 73.80 acres of land, 14 Aug 1830 and selling it 24 Oct 1836.
Thomas, his father, and brother Seth came to Linn County in 1835, settled on section 27, township 58, range 22. This section of land between Locust Creek and Parson Creek was known as a no more beautiful body of prairie land in the State of Missouri. Of a deep rich soil whose fertility was unsurpassed, it was in all respects a farmer’s paradise.
Linn County was organized 26 Dec 1836, and officially became a county 6 Jan 1837. There was no court house for a few years. A County Court was in the house of Thomas BARBEE. It was not until December that the Circuit Court met. The first act of the court was to empanel a grand jury. The first case which came before the court was that of Thomas STANLEY v. Thomas BOTTS. The defendant filed his plea of not guilty and justification. The case was continued to the next term of court, held 13 Aug 1838, when it was decided in favor of the plaintiff, by a jury of ‘twelve true men’. The Grand Jury came into Court on 11 Dec 1837, and having no presentments to make were by the Court discharged. The sheriff produced his account for $11.25, which was allowed and ordered to be certified to the County Court for payment. A copy of the entire procedure from the County Court in Linneus is long, very difficult to read as it is in long hand. The plaintiffs in the case were Canton USHER for himself and as guardian for Missouri LATHROM, and James YATES guardian for John LATHROM - a petition for partition of land. This day came the petitioners and it appearing to the Court that the said Caton USHER, Missouri LATHROM, and John LATHROM are seized in fee of one third undivided part of 3, 680 acres of land. The legal description is recorded.
In August 1838, the jury assessed Thomas BOTTS $600.00, plus the $11.25 cost to the sheriff, for damages. At the side of the account in the margin is written -- This judgment satisfied the 26th September 1838.
Commissioners were appointed to make partition of the lands between Canton USHER, and others, and to report at next term of court. Thus ended the first court proceedings in Linn County and which involved Thomas BOTTS.
The first wedding recorded in Clay Township, Linn County, was the marriage of John RYAN to Miss Susan BOTTS, daughter of Thomas and Martha in 1837. John RYAN has been listed as the teacher of the school near John (Judge) BOTTS.
In 1840 Thomas’ brother Seth and Wm. BOWYER commenced building a water mill on Locust Creek, some 3 1/2 miles west of Linneus, township 58, range 21. Before completion, BOWYER sold his interest to Thomas and the two brothers finished the mill the same year.
Thomas died 25 Apr 1852, and is buried in Botts Cemetery. He had become a wealthy land owner while residing in Linn County, leaving an estate to his heirs of over 1000 acres of land.
A great-great grandson, Elgin BOTTS, had a marker made and placed at the foot of his grave,

Joshua BOTTS, born 11 Dec 1811, was the oldest son of Thomas and Martha Wilson BOTTS. Joshua and John, Seth and Thomas ((who married Martha Wilson)) were the sons of Joshua BOTTS (who fought in the Revolutionary War). Again in Thomas’ family we find his two oldest sons named Joshua and Seth, followed by Thomas H. and John. About the only way to keep these families straight is to keep their dates of birth and death in mind. The names Joshua, John, Seth, and Thomas are repeated over and over again in each family and generation.

...The judge’s father, Thomas BOTTS, who was a soldier in the war of 1812, tore himself away from her whom he had just made his wife, and volunteered for the defense of his country. He ((Judge-John)) grew up here and was married in 1835, Miss Elizabeth, daughter of William HARVEY, becoming his wife. They were both quite young, the groom being only twenty and the bride fourteen, but their married life has been a happy one, and has been blessed with ten children, seven of whom are living: Louisa A., the wife of Dr. J.R. SANDS, of Salisbury; William M., of Linn County; John D., Fanny, the wife of Dr. Worthington MOREHEAD, and Misses Ella, Mary E., Nora B. and Emma B., all of this county ((Howard)).
