DAVID MARTIN

In the name of God amen  DAVID MARTIN of the County of Rockingham and State of North Carolina being sickly and weakly of body but in perfect mind and memory praise be therefore given to Almighty God  I do make and ordain this my last will and testament in manner and form as follows that is to say first and principally I do commend my soul to almighty God who gave it ........ my body I commit to the earth to be decently buried at the discretion of my executors hereafter named and touching the disposal of all such temporal estates it has pleased God to bestow on me I give and dispose of it as followeth  I give unto my dear and loving wife all and singular my land and tenements my stock of all kinds which I do now possess and also all my household furniture and with all my working tools belonging to the plantation during her widowhood  if she my wife should at this time be in a state of pregnancy I consider it to be my heir and to possess such part of my estate as the law will allow it to possess in such a case if no heir at her marriage or death or should she have abase begotten child in either of these cases I wish her to possess none of my estate but for it to be equally divided between my brotherand sister and I also wish all my just debts to be settled up our of my estate by my executors and I do hereby constitute and appoint my worthy friend CUMMINGS WITTY and JOHN  WINCHESTER JUNR to be my full and sole executors and no other of this my last will and testament and I do hereby revoke disanull and make void all former wills and testaments by me heretofore made and witness whereof I the said David Martin to this my last will and testament do set my hand and seal this second day of April one thousand eight hundred and fifteen
