I Drury SMITH of Rockingham County and state of north Carolina being well stricken in years and at times ailing and at other times in common health for a person of age and at this time in right mind and memory calling to mind the mortality of my body and knowing that it is appointed to all men once to die do make and ordain this my last will and testament - that is to say principally and first of all I commend my soul to the given and bountiful sustainer of all good and my body I recommend to the earth to be buried in Christian order at the discretion of my surviving friends and Executors and as touching such worldly property as it has pleased the Lord to help me with I am willing and I wish to dispose of it in the following manner & form. Item- I give and bequeath unto my son Frank SMITH one hundred acres of land a survey deeded whereon he now lives being the lower part of my plantation (to wit) beginning at a stump close his mill thence north sixty seven poles up the creek thence east 240 poles to NUNS old line also seventy five Acres more being part of a tract of land I bought from Ingram NUN of one hundred and fifty acres including that Tract that James READ [?] now lives upon. Item- I give and bequeath to my son Daniel SMITH two hundred acres of land beginning at Frank's corner and thence along his line east to the line called nuns old line and including seventy five acres the remaining part of the tract which I had surveyed joining Bartholemew GROGANS thence north as far as the the line called Ingram's line extend [?] then west to paw paw creek thence down said creek to where my old fence was thence east crossing little paw paw and then down said creek to Frank's line. Item- I give and bequeath to my two sons Johanon SMITH and Drury SMITH two hundred and thirty Acres of land the same I bought of Peter and George HUNTER to be equally divided between them. Item I give and bequeath to my Daughter Sally MAISE Fifteen pounds fourteen shillings and seven pence 1/2 Virginia money and from her to me by note . Item- I give and bequeath to my daughter Patsey GROGAN five dollars Item I give and bequeath to my daughter Polly MEANS a cow & calf and ten dollars Item- I give and bequeath to my son Thomas SMITH two hundred and seventy acres of Land including which we called ___'s old place and Land that I bought of William SMITH. Item- I give and bequeath to my daughter Susanah MOORE five dollars Item- I give and bequeath to my son Edwin SMITH one hundred and fifty Acres of Land which I bought of William MOTLY [?] in one survey Item- I give and bequeath unto my daughter Betsey OAKLEY twenty dollars Item- I give and bequeath to my daughter Nancy MEANS ten dollars Item- I give and bequeath unto my daughter Pheba SMITH a bed and furniture a cow and calf and all besides these she hath worked for. Item- I give and bequeath to my son John SMITH two hundred and eighteen acres of Land a grey mare colt feather bed and furniture a cow and calf &c. Item- I give and bequeath to my son Richard SMITH full priviledge of two hundred aces of land where ___ I now live that is so far as I wish him to live Live with my beloved wife Eleanor SMITH which to her I bequeath said two hundred acres of Land for the whole of her life also I lend unto her a negro man named Peter and desire him to be used for her support through her whole life & at her decease to be sold and the money divided equally among my sixteen children after being sold to the highest bidder at public sale and after her decease I give and bequeath the aforesaid two hundred acres of land It being my home tract containing my farm and plantation where on I now live and have for many years and I also give to my wife and deposit in my son Richard SMITH's care a bed and furniture and chest which if she lives and dies with him to be his property then and I also give to my son Richard to be his at all times a sorrel mare colt also a cow and calf & a feather bed and furniture and after my beloved wife's decease my son Richard SMITH to have full possession of my two hundred acres of land as aforesaid also I give and bequeath to my wife through life a bay mare and cold wishing these my desires to bear full effect I ___ anul [?] all others but this to be my last will and testament and for proper proceeding hereto. I constitute and appoint my trusty friend Josiah CLAYBROOK to be my soul executor also my two sons Frank SMITH and Daniel SMITH my trusty sons to be executors therewith nothing doubting but they will see my intentions herein mentioned take effect so wishing the lord may bless the world with temporal and eternal prosperity. Item- I give and bequeath to my son Frank SMITH thirty one and a quarter acres of Land deeds to me from William KALLAM and I wish my two stills to remain upon my plantation till my wife's decease and then divided between my two sons John SMITH and Richard SMITH so repeating my wishes for the prosperity of mankind in _____ and also eternal prosperity I hereunto again affix my hand & seal this 18th day of July AD 1822.
