Men by these present that I Rebecca Witherell of Rochester in the
County of Strafford & State of New Hampshire Widow for and In consideration
of the sum of One hundred dollars to me in hand before the delivery hereof
well and truly paid by my son James Witherell of the Same Rochester a Minor,
the receipt whereof I do hereby acknowledge have given granted bargained sold
and by these presents do give grant bargain sell alien enfeoff convey and
confirm unto him the said James Witherell his heirs & afsigns forever Twenty
Acres of land lying in said Rochester in the first division Numbered sixty
four drawn to the Original Right of Capt Thomas Tebbets and lies on the
Southwesterly end of Said lot and extends so far Northerly as to Contain
Twenty Acres and is the same that I received of my honoured Father Solomon
Clark as by Deed on Record before these presents shall more fully appear.
To Have and To Hold the Said granted premises with all the privileges and appurtenances to the Same belonging to him the Said James Witherell his heirs and afsigns to their only proper use and benefit forever and The said Rebecca Witherell my heirs executors and administrators Do hereby covenant grant and agree to and with the said James Witherell his heirs and afsigns that untill the delivery hereof I am the Lawful Owner of the Said Premises Seized and profsefsed thereof in in my own right in fee Simple and have full power and Lawful Authority to grant and convey the Same in Manner aforesaid that the Said premises are free and clear of all and every Incumbrance whatsoever and that I my Heirs executors and administrators shall and will warrant the same to the Said James Witherell his heirs and afsigns against the Lawful Claims & demands of any person or person whomsoever. In Witnefs whereof I have hereunto set my hand & Seal this thirtieth day of September in the year of our Lord one thousand eight hundred Two~ |
