Men by these present that I Robert Tebbets of Rochester in the
County of Strafford and State of New Hampshire, Husbandman, for and in
consideration of the sum of Two hundred and thirty six Dollars to me in hand
before the delivery hereof, well and truly paid by James Witherel of Limerick
in the County of York & Commonwealth of Massachusetts, yeoman, the reciept
whereof I do hereby acknowledge have given, granted, bargained & sold; and
by these presents do give, grant, bargain, sell, alien enfeoff convey and
confirm unto the said James Witherell his heirs and assigns forever a certain
piece or parcel of land situate lying & being in Rochester aforesaid, being
the part of lot numbered fifty three in the first division in said Rochester
which is now in my possession, and which I hold in my own right, however the
same may be butted & bounded, & whatever quantity of land it may contain by
admeasurement, together with all the buildings of every description and all
the privileges and appurtenances thereto belonging and is the homestead on
which said Tebbets now lives ~~~
To Have and To Hold the said granted, premises, with all the privileges and appurtenances to the same belonging to him the said James Witherell his heirs and assigns to his and their only proper use and benefit forever And I the said Robert my heirs, executors and administrators do hereby covenant, grant and agree to and with the said James his heirs and assigns, that until the delivery hereof I am the lawful owner of the said premises am seized and possessed thereof in my own right in fee simple, & have full power and lawful authority to grant and convey the same in manner aforesaid. That the said premises are free and clar of all and every incumbrance whatsoever And that I my heirs executors and administrators, shall & will warrant the same to him the said James his heirs and assigns, against the lawful claims & demands of any person or persons, whomsoever ~~ In witness whereof I have hereunto set my hand and seal this thirtieth day of December Anno Domini 1805 - |
