Men by these present that I Robert Tebbets of Rochester in the
County of Strafford & State of New Hampshire husbandman for and in
consideration of the sum of Nine hundred Dollars to me in hand before the
delivery hereof well and truly paid by James Witherel of Limerick in the
County of York and Commonwealth of Massachussetts yeoman the receipt whereof
I do hereby acknowledge have given granted, bargained sold, and by these
presents I do give grant, bargain sell, alien, enfeoff convey and confirm
unto him the said James Witherel his heirs and assigns forever, a certain
piece or parcel of land situate lying & being
in Rochester aforesaid, being the part of lot numbered fifty three in the
first division in said Rochester which is now in my possession & is also
the Land I own in said lot, with the buildings thereon, however the same
may be butted or bounded & whatever quantity of Land it may contain by ad
measurement and is the homestead on which said Tebbets now lives ~~
To Have and To Hold the said granted premises with all the privileges & appurtenances to the same belonging to him the said James Witherel his heirs & assigns to his & their only proper use & benefit forever; and I the said Robert Tebbets my heirs executors and administrators do hereby covenant grant and agree to & with the said James Witherel his heirs and assigns that until the delivery hereof I am the lawful owner of the said premises seized & possesed thereof in my own right in fee simple & have full power and lawful authority to grant and convey the same in manner aforesaid, that the premises are free & clear of all & every incumbrance whatsoever; and that I my heirs- executors & administrators shall and will warrant the same to him the said James Witherel his heirs & assigns against the lawful claims and demand, of any person or persons whomsoever In witnefs where of I have set my hand and seal this second day of February in the year of our Lord, one thousand eight hundred and eight. |
