COUNTY, ss:
On this
nineteenth day of August 1820, personally appeared in open Court (being a Court
of Common Please in and for said county and constituted
a Court of Record by proceeding according to the course of the Common
Law, with a jurisdiction unlimited in point of amount, and keeping a record of
its proceedings and recognized as such Court by the laws and judicial decisions
of said State,) DAVID SMITH, aged 58 years, resident in the town of Lyons in
said county, who being first duly sworn according to law, doth on his oath
declare, that he served in the Revolutionary War as follows:
First
in the Company commanded by Capt. Josiah SMITH in Col. TUPPER'S Regiment of the
Massachusetts line, afterward transferred into the Company commanded by Capt.
James BURTON in Col. Thomas MARSHALL'S Regiment of the same line – then
transferred into the eighth Regiment commanded by Col. Michael JACKSON and
Company commanded by Capt. SMITH, from which Company I was discharged in June
1783 at Snake Hill.
And
that he made application for a Pension on the Seventeenth day of April 1818 and
that he received a Pension Certificate No. 9234.
And I do solemnly swear that I was a resident citizen of the United
States on the eighteenth day of March, one thousand eight hundred and eighteen,
and that I have not since that time, by gift, sale, or in any manner disposed of
my property, or any part thereof, with intent thereby so to diminish it as to
bring myself within the provisions of an act of Congress, entitled, “An Act to
provide for certain persons engaged in the land and naval service of the United
States in the Revolutionary War,” passed on the 18th day of March,
1818, and that I have not, nor has any person in trust for me, any property or
securities, contracts or depts. Due to me, nor have I any income other that what
is contained in the Schedule hereto annexed, and by me subscribed, viz:

do further swear and declare that I am by occupation a shoemaker and that owing
to age and infirmity, together with violent Rheumatism and asthma, together with
a fracture on my skull occasioned by a wound received in the Battle at Stony
Point, I am totally incapable of supporting myself. My family consists of my wife, Lucretia,
aged forty six years, a cripple with the Rheumatism, my daughter, Lucretia,
aged fourteen years, my daughter, Polly, aged
twelve years, my daughter Cynthia, aged eleven
years, my daughter Sally, aged ten years, my
daughter Betsey, aged nine years, my son George,
aged eight years, my son David, aged seven years
and my daughter Nancy, aged five years.

Court of Common Pleas, held at the Court House in Canandaigua in and for the
County of Ontario, before the Judges of said Court, on the 19th day
of August of the term of August in the year one thousand eight hundred and
twenty:

In
the matter of David SMITH a Pensioner residing in the town of Lyons in said
County:
The
said David SMITH as a person placed on the Pension List of the United States,
having exhibited a Schedule subscribed by him, containing his whole estate and
income, (his necessary clothing and bedding excepted), in pursuance of an act of
Congress of the United States, entitled, “ An act in addition to an act”,
entitled “An act to provide for certain persons engaged in the Land and Naval
Service of the United States in the Revolutionary War”, passed on the
eighteenth day of March, one thousand eight hundred and eighteen, paged May 1,
1820; and having taken, subscribed and produced to this Court, the oath or
affirmation by the said act required, and the said Court having heard evidence
of the nature and value of property mentioned in the said schedule, and duly
considered the premises are of the opinion that the property contained in the
said schedule is of the value of thirty one dollars and five cents, and they
hereby order their Clerk to certify the same in due form.
To the
Hon. Of Court of Common Please of the County of Ontario, holden at the Court
House in Canandaigua, in and for said county on the term of May in the year of
our Lord, one thousand eight hundred and twenty.
I,
DAVID SMITH, being an actual resident of the town of Lyons in said county,
having been placed on the Pension List of the United States, by virtue of the
act, entitled “An act to provide
for certain persons engaged in the Land and Naval Service of the United States
in the Revolutionary War”, passed on the eighteenth day of March, one thousand
eight hundred and eighteen, do hereby pursuant to the act in addition to the act
above mentioned, passed May 1, 1820, exhibit to said Court the following as a
Schedule containing my whole estate and income ( my personal wearing apparel and
bedding excepted) that is to say:
2 Cows,
$35; 2 Hogs, $6; part sett shoe maker tools; 1 case ; 1 trammel; 1 pot; 1
spider; 1 wooden wheel; 1 linen wheel; sundry small articles, total value of
$52. 37.
I do
further swear and declare that I am fifty eight years of age, that I served in
the Revolutionary War in the Company of Captain SMITH in the Regiment of Col.
JACKSON in the Massachusetts line as set forth in my original declaration being
date the seventeenth day of April 1818, and that I received a pension
certificate No. 9234 and further that I am by occupation a shoemaker and that by
age and infirmity I am not able to perform manual labour more than one quarter
of my time and that my family consists of my wife aged 48 years, six girls and
two boys, the oldest of which is 14 years of age, a daughter, and that I owe
fifty one dollars now due and liable to be called on for the same.
In
testimony whereof, I have hereunto subscribed my name this 22nd day
of May, 1820.

foregoing exhibits an inventory and statement of Facts sworn in open Court the
22nd day of May, 1820.
