The will of Asa Vail

The people of the State of New York by the Grace of God Free and Independent to all to whom these presents shall come or may concern send greetings Knoweth ye that at Goshen in the County of Orange on the ninth day of March instant before James Everett Esq. Surrogate of our said County the last will and Testament of Asa Vail deceased (a copy where of is here unto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death good chattels or credits within this state by means whereof the proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing any final discharging the accounts there of doth belong unto us, the administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto WILLIAM VAIL, DANIEL DENTON and IRA VAIL the Executors in the said will named they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof when there unto required in Testimony where of we have caused the Seal of Office of our said Surrogate to be here unto affixed witness James Evertt Esquire surrogate of the said County at Goshen the Eleventh day March in the year of our Lord one thousand eight hundred and thirteen and of our independence the 37 year.
In the name of God amen I ASA VAIL of the Town of Goshen County of Orange and State of New York being in a low state of health but of a sound and disposing mind and memory blessed be God Do this second day of March in the Year of Lord one thousand eight hundred and thirteen do make and constitutes this my last will and testament in manner and form following to wit I do order that my just debits and funeral charges be paid in as short a time after my decease as shall be convenient Secondly I do give and bequeath unto my beloved wife Sarah the best room in the house where I now live also two beds and bedding thereto belonging and two bedsteds one riding horse known by the name of the young bay horse a good saddle and bridle two cows six sheep to be kept on the farm in summer and winter for her benefit one clothes cupboard six chairs shovel and tongs one pare andirons four sheets over and above what furniture belongs to the beds also twenty pounds of flax yearly which IRA VAIL & ASA VAIL are to pay to her also two pots and one kettle also I give and bequeath until my two sons Ira Vail & Asa Vail their heirs and assigns forever the farm wheron I now live together with two acres of the hemp land to be eaqually dividided between them and also I give and devise unto my two sons Ira Vail his heirs and assigns forever four acres of hemp land I also give and devise unto my two sons Ira Vail and Asa Vail their heirs and assign for ever all my lot of Cedar Swamp lying in the great Cedar Swamp and also I do order and direct that my two sons Ira Vail and Asa Vail their heirs Executors or administrators do pay or cause to be paid unto my son WILLIAM VAIL Thirty pounds to be paid to him in two years after my decease I also order and direct that my son ETON J. VAIL have the sum of Sixty pounds paid to him in two years after my death I also direct that my son DANIEL VAIL have sixty pounds paid to him in two years after my death I also direct that my two sons BENJAMIN VAIL and SIMEON VAIL be put to trades such as they shall chuse also I direct that my two sons Benjamin Vail and Simeon Vail have twenty pounds each to be put to interest after two years after my death and when Benjamin Vail and Simeon Vail arrive at the age of twenty one years i do order and direct that my two sons Ira Vail and Asa Vail do pay the same to them I also order and direct that my daughter HANNAH VAIL have sixty pound to be paid to her in two years after my death and also I direct that my daughter SARAH CONKLING have the sum of Sixty pounds paid to her in two years after my death I also order and direct that my daughter IRENE VAIL have the sum of seventy pounds paid to her in three years after my death also I do order and direct that all my household furniture except such as is given to my wife shall be divided eaqually among my three daughters Hannah Vail Sarah Conkling and Irene Vail also I do order and direct that my Executors shall sell my pine swamp lying adjoining JOHN YELVERTON's lot to pay my debts as far as it may go Also I give and bequeath all the residue of my moveable property to be equally divided between my two sons Ira Vail & Asa Vail Lastly I do make and constitute my my brother William Vail, Daniel Denton and my son Ira Vail my executors to my last will and testament in trust for the intent and purpose there in contained in Testamony whereof I have hereunto set my hand and seal the day and year first over written Seal published and declared by the said Asa Vail as and for my last will and testimony in the presents of us Ezra Conkling William Cook Asa W. Jackson. /S/ASA VAIL
Orange County (?) be It remembered that on the ninth day of March in the year of our Lord one thousand eight hundred and thirteen personally appeared before me James Evertt Surrogate of the Said County of Orange ASA W. JACKSON and being duly sworn upon his oath declared that he did see ASA VAIL deceased sign and seal the written instrument then shown unto him of which the preceding is a true copy purporting to be the last will and testament of the said decease bearing the date second day of March instant and heard him publish and declare the same as and for his last will and Testament that at the time thereof he the said deceased was of a sound disposing mind and memory to the best of the knowledge and belief of him the deponent and that he together with Ezra Conkling and William Cook subscribe their names thereto as witness in the testators presence and in the presence of each other.
The preceding is a true copy of the orginal will of ASA VAIL decease of the certificate of the proof thereof and the letters testamentary thereon. /s/ James Evertt Surrogate.
