Wills
I, Sarah A. Brien of the City of Middletown in the County of Orange and State of New York, being of sound mind and memory, do make, publish and declare this my last Will and Testament, in manner following, that is to say:
FIRST.- I direct that all my just debts and funeral expenses be paid.
SECOND.- I give and bequeath to my husband Henry Brien the sum of One hundred dollars: and as a further gift to him I direct my Executor hereinafter named to pay off and cancel a Mortgage upon my husband's House and Lot, number Thirty Three Wallkill Avenue, Middletown New York, being for the sum of Two hundred dollars.
THIRD.- I give and bequeath to my daughter in law Lydia Brien, wife of Harry the sum of Two hundred dollars.
FOURTH.- I give and bequeath to my son Harry Brien the sum of one hundred dollars.
FIFTH.- I give and bequeath to my son Edward Brien the sum of Six hundred dollars together with the Bed and Furniture in the room he is accustomed to occupy.
SIXTH.- I give and bequeath to my sister in Law, Ettie Babcock, my silver caster.
SEVENTH.- I give and bequeath to my sister in law, Ettie Drew, my Gold breast-pin set with diamonds.
EIGHTH.- I give and bequeath to my sister Abby Montross the sum of Fifty dollars.
NINTH.- I give and bequeath to my Half-sister, Alice Babcock a Bedstead and bedding, being the one she used to occupy when at my house.
TENTH.- The remaining Furniture and Household goods not herein bequeathed I give to my husband, Henry Brien.
ELEVENTH.- All the rest residue and remainder of my Estate I give and bequeath to my son Edward Brien and to my Daughter-in-law Lydia Brien, to be equally divided between them, share and share alike.
LASTLY, I hereby appoint John D. Stivers of the City of Middletown Orange County N.Y. executor of this, my last Will and Testament; hereby revoking all former wills by me made.
IN WITNESS WHEREOF, I have hereunto subscribed my name the Fourth day of July in the year One thousand nine hundred and two.

We, whose names are hereto subscribed, DO CERTIFY, that on the 4th day of July 1902 at the City of Middletown Orange County N.Y. the testatrix subscribed her name to this instrument in our presence and in the presence of each of us, and at the same time, in our presence and hearing, declared the same to be her last Will and Testament, and requested us, and each of us, to sign our names thereto as witnesses to the execution thereof, which we hereby do in the presence of the testator and of each other, on the said date, and write opposite our names our respective places of residence.

In the Matter of Proving The Last Will and Testament State of New York,
of Orange County, ss:
Sarah A. Brien, Deceased.
May H. Corwin and Mary A. Ellen of the City of Middletown in the County of Orange, having on this 11th day of August in the year one thousand nine hundred and two personally appeared before Hon. John B. Swezey Special Surrogate of the County of Orange, and being by the said Surrogate duly sworn and examined, depose and say, and each says, that they was well acquainted with Sarah A. Brien late of the City of Middletown in said County of Orange, deceased: that they were present as witnesses and did see the said Sarah A. Brien deceased, bearing date the 4th day of July in the year one thousand nine hundred and two; that such subscription was made by the said Sarah a. Brien now deceased, in the presence of these deponents the attesting witnesses to said Will: That the said Sarah A. Brien at the same time declared to said witnesses the instrument so subscribed by her to be her Last Will and Testament; Whereupon these deponents each signed her name at the end of the said Will at the request of the said testatrix now deceased; That each so signed in the presence of the said deceased and of each other, and that the said Sarah A. Brien at the time of executing and publishing the said Last Will and Testament was of full age, of sound mind and memory, and not under any restraint and was a citizen of the United States.

The Citation in this matter having been duly issued, served and returned, such proceedings were thereupon had that the proofs were duly taken; and the allegations of the parties appearing having been heard, and the Surrogate having inquired particularly into all the facts and circumstances, and being satisfied of the genuineness of the Will, the validity of its execution and the competency of the testatrix and the probate of said Will not having been contested:
IT IS ADJUDGED, that the instrument offered for probate in this matter is the last Will and Testament of the said testatrix and as such is valid as a Will of personal property, and that Letters Testamentary be issued thereon to the Executor who may qualify thereunder.
